본 연구는 이산가족에 대한 문제를 국제 규범적 접근으로 고찰한 논문이다. 이산가족의 정의와 권리 그리고 국가적 책무를 검토하고 국제인권법적으로 이산가족 현안을 재조명하였다. 또한 국제인도법상 국제적십자위원회(ICRC)의 지원규정을 중심으로 이들의 국제법적 권리를 탐색했고, 특별히 제네바 협정과 국제적십자위원회로 대표되는 국제기구가 가지고 있는 우리나라 이산가족에 대한 책무와 관할권을 중점적으로 탐구하였다. 이러한 연구방향을 바탕으로 국제적십자위원회를 통한 실질적인 방안을 모색하고 이산가족문제를 UN 관련 위원회들에게 보내는 청원서(Petition) 등을 통하여 국제적으로 공론화하는 방법을 연구했다. 특히, 국제적십자위원회의 심인사업 소개와 대표적인 사례에 대한 심층분석을 통해 ICRC의 중재와 위탁을 필요성을 강조하고 중앙심인사업본부(Central Tracing Agency)의 활동을 중요성을 논하였다. 또한, 국제사회 및 해외교포 사회와 국내외 대북 인권 및 인도지원 그리고 민간․종교채널과 UN 및 국제인권 구제제도를 적극적으로 활용하는 이산가족 문제의 해결방안을 모색하였다.
Abstract
This study addresses North and South Korea’s separated family reunion issues. The paper take a “normative approach” to resolving separated families’ reunion issue. The paper frames the separated family as a human rights issues rather than humanitarian issue. The updated definition and legal rights of separated families in both national and international legal context was examined. The duty and legitimate obligation of states and its breach of duty was discussed. Furthermore, lawful rights of the separated families based on international norms and treaty party obligation was discussed in particular compelling regulation of International Organizations, such as International Committee of the Red Cross(ICRC) was examined. Especially, paper argues for the Fourth Geneva convention(1949), Protocol I additional to the Geneva Conventions(1977) and Resolutions of the XXIVth international Conference of the Red Cross to confirm valid responsibilities and authorized jurisdiction of ICRC as well as other International Organizations in area of separated family. Moreover, practical remedy measurements, mainly UN human rights petitions and activity of ICRC Central Tracing Agency were introduced. Especially, via in-depth analysis of historic cases and introduction of the family tracing business of ICRC, the paper discussed challenge and necessity of officially activating arbitration and engagement from ICRC’s Central Tracing Agency for Korean situation. Furthermore, the paper calls for international cooperation in promoting the rights of Korean separated family by actively utilizing oversee Korean society, and utilizing domestic and foreign North Korea human rights NGOs and humanitarian assistance networks as well as private, religion channel, UN, and international human rights mechanism. Lastly, Governmental-academic-civil societies collaboration must be formed in order for effectively advocating for rights of separated families as international human rights issues of concern rather than a local Korean humanitarian issue.
