Abstract
The core of confidence in judiciary depends on that people are being provided a fair trial. An act of undermining public confidence in judiciary connotes the substantial unlawfulness because it may destruct the foundation of rule of law. This article focuses on an act of expression that obstructs the administration of justice by infringing acts such as publishing on trial untimely, stating a false statement, or scandalizing the court. In UK, a trial by newspapers has always been something that should be avoided by all means. Also, the law of contempt of court governs an act that limits freedom of expression in US and Singapore by providing different standards of limiting freedom of expression respectively. Freedom of expression is surely a fundamental right in democratic society, but not an absolute right that can be limited according to situations. The right weighs the same as the right to receive fair trial. This article suggests a way of balancing both rights within the purview of the law of contempt of court.
