Abstract

This article focuses on the political and legal relations and the distribution of budget authority between the U.S. Congress and the Federal Executive, mainly examining how the political and budgetary powers have been distributed. Essentially from a constitutional perspective, the distribution of authority and authority in the legislative process between the U.S. Congress and the Federal Executive has long been shaped by parliamentary practices, legislative acts and precedents. It is worth noting that especially the independent legislative power of the President including veto power has been recognized in various forms, although the legislative power has been regarded as the exclusive property of Congress. In addition, with regard to the allocation of budget authority, it can be seen that, in particular, congressional traditions and customs in the approval process of the budget fill gaps which exist between the Executive and Congress, since there are no specific provisions under the U.S. Constitution. Also, since appropriation bills are passed in the form of the congressional acts, other laws against the appropriations can be amended directly by the appropriation acts if necessary to ensure budget and legal consistency. Also, in the process of deliberating and deciding the appropriation bill, the Congress can contribute to the realization of budgetary democracy as a representative of the people and secure democratic legitimacy on budget. The common reasonableness of allocating U.S. budget authority is based on the division of the House and Senate, which can be found in the pursuit of budgetary division and the ideals of balanced budget. The roles and functions of the Senate and the House of Representatives can also be understood for a long time in terms of political consensus and power control through the functions of the House and Senate Committees. Indeed, we should pay attention to the fact that the relationship between the Federal Executive (especially the President) and the U.S. Congress over the 200-year history of roles and functional division has been established, followed by reasonable distribution of law-making power, budget authority, and appropriation acts to realize legitimacy and budgetary democracy.
