미국 연방 대통령의 예산법률안 거부권과 연방 의회의 쪽지 예산에 대한 비교법적 연구

미국 연방대통령이 가진 권한 중 연방 의회에 대한 견제권한으로 법률안 거부권이 존재한다. 우리나라와 달리 미국 연방정부는 법률안 제출권이 없기 때문에 연방 의회를 견제하는 매우 중요한 권한이다. 미국 연방대통령의 법률안거부권은 환부거부(return veto)와 보류거부(pocket veto 또는 pigeon hole veto) 두 가지 형태가 있다. 미국 연방대통령의 예산법률안에 대한 거부권은 전부거부만을 전제로 할 때 연방대통령의 거부권 행사로 말미암아 연방정부의 재정시스템이 정상적으로 가동되지 못하는 교착상태에 빠질 수도 있는 우려가 있어, 소위 “일부 거부권 또는 항목별 거부권”에 대한 필요성이 지속적으로 논의되어 왔다. 아울러 미국 연방의회는 예산법률안을 심사하면서 연방의회의 의원들의 재정적 소여를 충족시키기 위한 소위 ‘쪽지 예산’이라는 이름의 예산제출권을 활용하고 있다. 이러한 쪽지 예산이 과연 연방대통령과 연방의회의 재정권한의 배분 및 견제와 균형의 관점에서 어떠한 의미를 갖는지 판단하기 위하여 연방 대통령의 일부 거부권 또는 항목별 거부권과의 관계를 구체적으로 살펴볼 필요가 있다. 연방 의회의 예산법률안에 대한 연방 대통령의 통제 내지 견제 권한의 필요성이라는 중요한 권력분립의 관점이 작용할 수밖에 없는 상황에서 연방 대통령에게 일부 거부권 또는 항목별 거부권이 부여될지 그 귀추가 주목된다.
Abstract
Among the powers of the U.S. Federal President, the right to veto legislation exists as a check on the Federal Assembly. Unlike Korea, the U.S. federal government has no right to submit legislation, so it is a very important authority to check the Federal Assembly. The U.S. Federal President's right to reject legislation comes in two types: return veto and pocket veto. The need for a so-called “partial veto or line item veto” has been constantly controversial because there is a concern that the federal government's fiscal system may not operate normally due to the exercise of the veto power of the U.S. Federal President's budget bills. In addition, in reviewing the budget bills, the U.S. Congress is using the right to submit a budget named the so-called “earmark budget” to meet the financial needs of members of the Federal Assembly. In order to determine what this note budget means in terms of the allocation, checks and balances of fiscal powers of the Federal President and the Federal Assembly, it is necessary to examine the relationship between the Federal President's partial veto or line item veto power. Attention is focusing on whether the federal president will be granted some veto or line item veto power at a time when the important separation of powers, such as the need for federal president's control or checks on the federal parliament's budget bills, is inevitable.
