법이 공동선을 목적으로 한다는 명제는 자연법이론의 핵심이다. 공동선은 개인이 법을 준수해야 하는 토대를 제공한다. 공동선을 추구하지 않는 법은 정의롭지 않은 법이며, 그런 법은 애당초 법이 아니다. 그런데 현대 법(철)학은 공동선 개념을 거의 다루지 않는다. 이제 공동선 개념은 법률가들조차 망각한 지 오래다. 본 논문은 아리스토텔레스와 아퀴나스가 법의 목적으로 제시한 공동선 개념을 복원하는 것을 일차적인 목적으로 한다. 흔히 공동선을 복지와 동의어로 오해하는데, 그 이유는 아리스토텔레스가 공동선을 공동체의 행복으로 정의한 것과 관련된다. 아리스토텔레스가 말한 공동체의 행복은 주관적 감정이 아니라 사회의 구성원들이 사회 속에서 각자의 유익을 추구하는 가운데 이성적 질서에 따라 정의롭게 행동하는 원리를 통해 각자의 유익이 더 잘 추구될 수 있다는 점을 지적하는 것이다. 따라서 공동선은 사익과 별개로 공익을 누리는 실체가 있다든지 공동체 구성원이 복지를 누린다든지 하는 것을 의미하지 않는다. 공동선 개념은 자유로운 개인들이 공동생활을 함에 있어 유념해야 하는 질서 또는 원리에 가깝다. 물론 정의로운 시민과 훌륭한 개인, 그리고 공동체 사이에 긴장 관계가 존재하며 공동선 개념을 이해하는 연구자들 사이에도 공동선 개념에 관한 합의가 어려운 것이 사실이다. 현대 사회에 이해관계가 다변화되고 집단화되는 경향이 강한 점을 지적하면서 이에 대처하는 데 아퀴나스의 공동선 개념은 도움이 되지 않는다고 비판하는 견해도 있다. 그러나 법을 제정할 때 이해관계를 잘 조정하는 일의 어려움은 분명해도 공동선을 목적으로 법이 만들어진 이상 그 법을 해석하고 집행하는 단계에서 무엇보다 더 유념해야 하는 것이 공동선이다. 이해관계의 조정이 어렵다는 사정은 법률가가 공동선을 외면해도 되는 정당한 이유가 되지 못하며 오히려 공동선 개념을 더 정교하게 다듬어가야 할 강력한 이유가 된다.
Abstract
The thesis that the common good is the purpose of the law is the core of natural law theory. The common good provides the ground for obeying the law. However, modern studies on law do not treat the common good as the main theme. This article aims to reintroduce the concept of the common good of Aristotle and St. Thomas Aquinas. Some misunderstandings about the common good are related to the eudaimonia of Aristotle. Eudaimonia means common advantage which social life led by just reasons produces to the community, so it approaches rational order or principle of social life. Of course, there is tension between being a good person and being a just citizen within a community, so debates still go on the concept and role of the common good among researchers. Modern society has problems from conflicting interests. Some assert that the concept of the common good of Aquinas is useless. But for lawyers, if any laws are made for the common good, it is the lawyer’s primary task to discern and execute the common good for the community. So difficulties in handling the struggling interests do not give immunity to the lawyer's tasks but provide strong motives to recover the core concept of the common good.
