블록체인은 개방성과 탈중앙화, 분권성 등을 핵심 가치로 하며 기존의 웹 환경에서 형성된 폐쇄성과 중앙집중성을 해소하는 기능을 수행하고 있다. 이 점에서 보면 블록체인은 경쟁친화적인 속성을 내포한다. 기업거래의 투명성을 제고하고 경쟁법 집행의 효율성도 개선하는데 큰 역할을 할 것으로 기대되기도 한다. 하지만 다른 한편으로는 지나치게 높아진 투명성이 경쟁자들간의 거래정보를 공유하여 카르텔을 조장하거나 유력한 블록체인 기술을 선점한 사업자들이 새로운 독점지대를 형성 유지하기 위한 전략으로 배타적 거래환경을 조성할 가능성 또한 예측되고 있다. 블록체인이 공공 및 기업환경, 그리고 상업적 거래의 핵심으로 등장하게 될 향후에 이런 문제들은 가시화되어 정책당국 및 입법자들의 대응을 요구하게 될 것으로 전망된다. 이글에서는 블록체인 시대의 경쟁법적 함의를 분석하고 관련 이슈들을 추출하는 한편, 이에 대응하기 위한 기업 및 정책당국의 전략방향을 제시하였다.
Abstract
Blockchain has its core values such as openness, decentralization, and decentralization, and is performing the function of solving the closedness and centralization formed in the existing web environment. In this respect, the blockchain has a competitive-friendly property. It is also expected to play a major role in enhancing transparency in corporate transactions and improving the efficiency of competition law enforcement. However, on the other hand, it is also predicted that excessively high transparency will promote a cartel by sharing transaction information between competitors, or create an exclusive transaction environment as a strategy for preoccupied with powerful blockchain technology to form and maintain a new monopoly. In the future, when blockchain will emerge as the core of public and business environments and commercial transactions, it is expected that these problems will become visible and require response from policy authorities and legislators. This article analyzes the implications of competition law in the blockchain era, extracts related issues, and suggests the strategic direction of companies and policy authorities to respond to this.
