영유아 보육인권의 본질과 쟁점에 관한 연구

인권은 천부인권적 권리로서 보육대상인 영유아나 이들의 보육자인 교사 등 누구에게나 태어나면서부터 부여된 자연적 권리이다. 최근 사회에서 발생하는 일련의 사건들에서 보육교사들이 영유아의 권리를 지켜주는 역할을 하는 자로서라기보다는 오히려 그들의 권리를 침해하고 있는 부정적인 모습으로 비춰지기도 하였다. 국제적으로 유엔 아동권리협약상 아동에 대한 권리로 생존권, 보호권, 발전권, 참여권이 논의되어왔고, 아동들에게 보장된 권리가 영유아에게도 인정되는 인권으로 보아야 한다. 영유아보육법과 모자보건법 규정에 따라 영유아는 ‘출생부터 만6세 미만의 취학전 어린이’로 개념 정의할 수 있다. 영유아 보육의 관점에 따른 본질규명을 위해 생태적 관점, 주체적 인간으로서의 관점, 기본권 능력을 지닌 존재로서의 관점, 전달체계 구축 대상으로서의 관점에 따른 고찰과 영유아 보육이념이 추구하는 방향을 제시하였다. 영유아 보육인권에서의 논의되어온 쟁점으로 영유아의 놀권리, 참여권과 아동학대와 관련해 CCTV설치 문제를 다루었다. 또한 보육현장에서의 보육대상인 영유아의 인권교육과 보육교사들에 대한 인권교육의 중요성과 방향에 대해 살펴보았다. 인권교육을 통해 영유아는 자신의 권리를 보호하고 나아가 타인의 권리를 존중하는 태도와 행동을 기를 수 있게 된다. 또한 보육교사의 인권감수성과 인권의식의 향상을 위한 지속적인 인권교육의 실시와 이를 위한 정책적 지원이 마련되어야 할 것이다.
Abstract
Human rights are natural rights that have been granted to all the children, the infants and their care teachers, as natural rights. In a series of recent events occurring in society, child care teacher was seen as a negative one, rather than a person who was protecting the rights of infants and children. Internationally, the right to survival, protection, development and participation has been discussed as rights to children under the United Nations Convention on the Rights of the Child, and the rights guaranteed to children should be viewed as human rights recognized by infants and children. Under the provisions of the Infant Child Care Act and the Hat Health Act, infants and children can be defined as “kindergarten children under the age of six from birth.” In order to clarify the essence of infant care from the perspective of infant care, the direction pursued by infant care ideology and consideration based on the ecological perspective, the perspective as a subject of self-reliance, the view as an entity with basic rights, and the view as a target for the establishment of the delivery system were presented. Issues that have been discussed in infant care and human rights have dealt with the installation of CCTVs regarding infants’ right to play, right to participate and child abuse. It also looked at the importance and direction of human rights education for infants and children subject to child care at child care sites and for child care teachers. Through human rights education, infants and children will be able to protect their rights and further foster attitudes and actions that respect the rights of others. In addition, continuous implementation of human rights education for child care teachers and improvement of human rights awareness should be provided and policy support should be provided for them.
