고교학점제 도입에 따른 법과 인권 관련 교육과정 구성 방안 탐색-각국의 고등학교 선택 과목 교육과정 분석을 중심으로-

본 연구는 고교학점제 도입과 2022 개정 교육과정의 개발을 고려하여 법과 인권 관련 고등학교 교육과정의 내용 구성 방안을 탐색하기 위한 목적으로 수행되었다. 이를 위해 우선 고교학점제 도입 관련 정책을 살펴보고, 이러한 정책적 변화가 사회과교육에 미치는 영향에 대하여 분석하였다. 고교학점제 도입과 함께 적용될 예정인 2022 개정 교육과정에서 법, 인권 관련 교육과정이 어떻게 구성될 수 있을 것인지 보다 구체적으로 살펴보고자, 본 연구에서는 캐나다 온타리오 주, 핀란드, 호주 뉴사우스웨일즈 주, 독일 베를린 주의 고등학교 법, 인권 관련 과목의 교육과정을 우리나라의 2015 개정 교육과정과 비교⋅분석하였다. 각국의 교육과정을 분석한 결과, 우리나라와 같이 정치 영역과 법 영역을 통합하여 고등학교 선택 과목을 제시하는 경우는 찾아보기 어려웠으며, 대부분 법을 중심으로 과목을 구성하고 인권 관련 내용은 다른 과목 내에 포함되는 주제로 다루고 있었다. 또한 분석 대상 국가나 주의 교육과정에서는 대부분 법에 대한 기초, 민법, 형법 등 내용을 공통적으로 다루고 있었다. 국가나 주마다 법 관련 선택 과목의 수는 차이가 있었으며, 캐나다 온타리오 주와 같이 관련 과목이 여러 개 제시된 경우에는 이수 경로를 제시함으로써 학생들의 과목 선택에 도움을 주는 경우도 있었다. 고교학점제가 제대로 정착하기 위해서는 2022 개정 교육과정의 성공적인 개발이 무엇보다도 중요하다. 본 연구의 분석 결과가 2022 개정 사회과 교육과정 개발 및 법, 인권 관련 교육 내용 구성 과정에 기초 자료로 활용될 수 있기를 기대한다.
Abstract
With the upcoming introduction of the high school academic credit system and the 2022 curriculum revision, this study was conducted to explore the composition of the contents of the law and human rights related high school curriculum. First, this study was covered with the policies related to the introduction of the high school credit system, and analyzed the impact of these policy changes on social science education. In order to analyze how law and human rights curriculum can be organized in more detail in the 2022 revised curriculum, the curriculum for high school law in Ontario (Canada), Finland, New South Wales (Australia), and Berlin (Germany) and Korea’s 2015 revised curriculum. After analyzing the curriculums of each country, it was difficult to find cases like Korea where political studies and law are integrated and studied as a single elective course. In other places, there were courses focusing on law, and human rights-related subjects were taught within other social study subjects. Introduction to legal studies, civil law, and criminal law were the most commonly covered subjects among the education system of the countries in the study. The number of elective courses related to law differed by country or state. In some cases, such as in Ontario, Canada, there were multiple related courses and students were provided with guidance on what sequence to take them in when selecting subjects. To put the high school credit system in place, the successful development of the revised curriculum in 2022 is essential. We hope the results of this study can be of use in the development of social studies, law, and human rights curriculums in the 2022 revision.
