남녀고용평등법상 성차별 구제에 관한 최근 미국 판례의 시사점

본 연구는 「남녀고용평등법」의 성차별 구제 관련 실효성을 높이기 위해 임신한 여성과 관련한 최근 미국 판례를 분석한다. 고용평등에 관한 소송에서 미국 내 법은 일반적인 불법행위소송과 달리 입증책임에 대한 전환 규정을 두고 있다. 즉, 원고는 먼저 성차별과 관련한 주장과근거를 제시하고, 사업주는 이에 대한 반증을 하게 된다. 원고는 사업주의 주장에 대해, 위법을은폐하려는 구실에 불과하다는 재반증 절차를 거치게 된다. 이러한 접근방식은 간접차별이 흔한 성차별 사건에서 근로자에게 용이하며, 국내에도 도입이 된다면, 실무에 있어서 피해자 구제에 도움이 될 것으로 예상이 된다. 또한 입증책임전환 규정과 함께 피해 근로자를 대신하는소송권을 제3의 기관에 위임한다면, 기관을 통한 「남녀고용평등법」의 예방적 기능이 활성화될 것으로 기대된다.
Abstract
This paper deals with South Korea’s Employment Discrimination Legislation and the implications of a recent Supreme Court decision on Korean law. According to the McDonnell Douglass burden shifting framework, an employee may present their initial case to the court, as to which an employer can argue that such discrimination was necessary for business purposes. The employee has an opportunity to argue that the employer’s reason for discrimination is merely pretext and that the employer should be held accountable for gender discrimination. Another characteristic of employment discrimination cases in the U.S. is that when gender discrimination occurs, the Equal Employment Opportunity Commission becomes involved from the initial stage of illegality. If such an institution can be established in South Korea, victims of gender discrimination in the workplace can rely on the institution for assistance in filing a case as well as enduring a trial.
