디지털 성폭력의 특징은 최초 유포자 뿐만 아니라 누가 언제든지 다시 피해 촬영물을 재유포 할 수 있다는 것이다. 디지털 성폭력의 피해확산을 막기 위해서는 유포된 촬영물들을 신속하게 삭제하여 더 이상의 유포를 막는 것이 중요하다. 유포된 촬영물이 신속하고 완전하게 삭제되지 않으면 피해가 지속적으로 발생할 수 있기 때문에 촬영물의 신속하고 완전한 삭제는 피해자의 피해 구제에 있어서 매우 중요한 부분이다. 이를 위해서는 단순히 유포 가해자만을 처벌하는 것 뿐만 아니라, 인터넷서비스업자에 대한 규제가 제대로 이루어져야만 피해 촬영물의 빠른 유포를 억제할 수 있는 효과가 있다. 또한 수사기관에서 피의자 수사과정 중 압수한 영상물, 사진 등을 폐기할 수 있도록 규정한다 면 좀 더 빠르게 피해 영상물, 사진 등을 처리할 수 있을 것이다. 법률에 삭제명령을 도입한다 면 법원은 판결 시 가해자의 처벌 외에도 삭제명령을 부과함으로써, 이후 가해자가 삭제하지 않고 소지하는 행위를 규제할 수 있고, 판결 이후의 가해자의 재유포 행위에 대해 민사, 형사상 처벌이 용이할 수 있을 것이다.
Abstract
The characteristic of digital sexual violence is that not only the original spreader but also anyone who can re-distribute the damaged images at any time. In order to prevent the spread of the damage, it is important to quickly delete the videos, photos that have been circulated to prevent further spread. Damage can continue to occur if the video is not quickly and completely deleted. Therefore, quick and complete deletion of the photographs is a very important part of the victim's relief. In order to do this, it is necessary not only to punish only the perpetrators, but also to regulate the Internet service provider. It will be effective to suppress the rapid spread of the damaged video. In addition, if the investigation agency stipulates to dispose of confiscated images, photos, etc. during the investigation of the suspect, it will be possible to process the damaged images and photos more quickly. If a law requires an injunction, the court may impose an injunction in addition to the punishment of the perpetrator in the judgment. After that, the perpetrator can regulate the act of carrying without being removed. And civil and criminal punishment of the offender's redistribution after the judgment can be easy.
