사회적 약자와 소수자의 인권문제와 인권개선에 대한 사회심리학적 접근 : 범주화와 보편적 성원권을 중심으로

사회적 약자와 소수자의 인권문제는 이들이 사회적 강자와 다수자에 의해 불합리하고 과도하게 제한적인 방식으로 특정 집단의 성원으로 범주화되고, 그로 인해 모든 인간이 공평하게 보장받아야 할 권리가 부여되지 않기 때문에 발생한다. 이런 문제를 개선할 수 있는 근본적 해법은 기존의 제한적이고 배타적인 사회 성원권을 더욱 보편적이고 포용적인 사회 성원권으로 대체하는 것이다. 본 연구의 자료는 2017년 9월 만 19세 이상 성인 인구를 대표할 수 있는 1,026명의 표본을 대상으로 인터넷 조사를 통해 수집했다. 주요 연구결과는 다음과 같다. 첫째, 보편적 성원권의 대리변수로 측정한 주민 성원권을 지지하는 응답자 비율이 53.2%로 높았다. 둘째, 주민 성원권을 지지하는 사람일수록 다문화수용성이 높고, 사회적 약자와 소수자가 부당한 사회적 처우(편견, 인격 무시/모욕, 차별 등)를 받고 있다고 인식했다. 셋째, 주민 성원권을 지지할수록 사회적 약자와 소수자의 인권개선을 위해 개인 차원의 노력뿐만 아니라 「차별금지법」 제정과 같은 제도적 차원의 접근을 지지했다. 본 연구의 법정책적 함의는 이미 한국사회에는 외국인이 실질적이고 중요한 사회구성원인 만큼 내국인과 외국인을 모두 포함하는 주민 성원권에 근거해서 인권의 법적 근거와 체계를 정비할 필요성을 제시한 것이다.
Abstract
The human rights problems of the socially underprivileged and the minority arise because they are categorized as members of a certain group in an unreasonable and overly restrictive manner by the socially powerful and the majority, thereby denying the right for all human beings to be equitable. The fundamental solution to this problem is to replace the existing limited and exclusive social membership with more universal and inclusive social membership. The data for this study were collected through an internet survey of 1,026 sample representing the adult population over the age of 19 in September 2017. Major research findings are as follows. First, the proportion of respondents supporting local resident membership, used as the proxy variable of universal membership, was high at 53.2%. Second, respondents who support local resident membership were more likely to have a higher level of multicultural acceptance and were more sympathetic to unfair social treatment of the socially underprivileged and the minority (prejudice, personal disregard/insult, discrimination, etc.). Third, respondents who support local resident membership were more likely to support the institutional approach such as enacting anti-discrimination laws as well as individual efforts to improve the human rights of the socially disadvantaged and minority. The legal and policy implication of this research is to suggest the need to develop legal bases and systems of human rights on the basis of local resident membership that includes foreigners as actual and significant members of Korean society.
