민영소년원의 설립 및 운영방안에 관한 연구

Abstract

Juvenile protection services, which accommodate juveniles in stable environment to prevent from anti-social behavior growing and provide comprehensive treatments, have been carried out by the public juvenile training school. However, as the participation of private sector on public projects increased, several Western countries and South Korea implemented privatization of adult prison. But there are arguments for and against the effects of privatization on correctional services for adults criminals. In the history of juvenile justice in the U.S. and South Korea, private groups built juvenile facilities to protect from delinquency, even before public facilities were operated largely. And considering the characteristic of protective dispositions which prohibit life imprisonment and death penalty for juveniles, much more support from the community is needed. In addition, the facility where No. 6 disposition is implemented can be considered as a private juvenile training school in view of the system of other countries. Reviewing on a couple of cases of private institutions in the U.S., it seems that the outcome of private facilities may vary depending on the provider and it’s important to focus on the operator more than the different ownerships types. Based on the above discussion and proposed law, this article seeks ways for the establishment and operation of private facility.
