Abstract

Checks and balances and separation of powers into a legislature, an executive, and a judiciary has been established as principle of government to prevent excesses or neglects of state powers encroaching basic rights of people against the obligations of states under the constitution. Above all, oversight and control of police power closely associated with administrative and judiciary power of states is of a great importance due to its intrinsic invasive and discretionary characteristics. External control of police by the people as the master, at the same time, and the subject of police power has been recently emphasized by international society. However, such institutions in Korea―The National Human Right Commission and The Anti-Corruption & Civil Rights Commission―lacking professionalism, neutrality and effectiveness have failed to exercise proper control over police. As the current efforts of this administration to reform a structure of state powers deepen the justifiable concerns about aggrandization of police and invasion on rights of people, exploration to reform the existing institutions for external civilian control of police must be accompanied. Considering that separation of investigation and indictment is being pursued as a part of the state power structure reform according to the principle―separation of power and checks and balances―recognized in all countries and ages, this paper aims to learn from UK which has firmly established separation of investigation and indictment and external civilian control of police securing professionalism, neutrality and effectiveness after several institutional reforms―Police Complaints Board (PCB) in 1977, Police Complaints Authority (PCA) in 1985, Independent Police Complaints Commission (IPCC) in 2003, and Independent Office for Police Complaints (IOPC) in 2018―over 40 years.
