Abstract
In Indonesia, it was by successive constitutional amendments after the collapse of Soeharto’s regime in 1998 that the direct presidential election system was first introduced. However, it seems to pose a number of questions in actual operation since the first direct presidential election in 2004. There are many kinds of political parties which are representing Indonesian society as a multiracial, multi-religious, multilingual and multi-cultural society. This kind of political and constitutional circumstance resulted in a distinctive electoral system. The President and Vice-President being elected as a single ticket directly by the people, each ticket of candidates for President and Vice-president shall not only be proposed by political parties or coalition of political parties which are participants in the general elections, but also, a party or coalition of parties has to meet a minimum requirement in order to nominate a candidate, in other words, thresholds. With the higher thresholds (at least 20% of the seats in Parliament, or a minimum 25% share of the national vote in the last legislative election), freedom of political parties and people’s right to vote could be limited unconstitutionally. It is desirable to adjust it downward. The Constitutional Court of Indonesia declared in 2013 that holding separately legislative and presidential elections was unconstitutional. Concurrent elections being expected in 2019. It poses several questions in constitutional practice, which require another constitutional and/or legislative resolution.
