기후변화는 환경뿐만 아니라 인권의 문제이기도 하다. 전 세계의 많은 사람들이 이미 기후변화로인해 그들의 생명, 물, 음식, 건강, 주거, 그리고 다른 권리에 영향을 받고 있다. 이에 지난 2015년 파리협정이 채택되기 전, 그린피스와 엠네스티 인터내셔널에서는 인권차원에서 기후변화에 대한 국제사회의 적극적이고 긴급한 대응을 촉구했다. “기후변화가 환경의 질에 영향을 미치고, 환경의 질은 기본적인 인권의 향유와 밀접하게 관련되어 있으며, 이는 기후변화가 인간의 기본적 권리를 위협할 수 있다”는 환경과 인권의 상관관계에 대한 인식의 제고는 꾸준히 진행되어 왔다. 기후변화가 인권의 완전한 향유에 부정적인 영향을 미친다는 사실은 국제사회에서 널리 인정되고 있으며, 기후변화로 인해 특히 영향을 받는 실체적 인권으로는 생명권, 건강권, 주거권, 식량에 관한 권리, 물에 대한 권리 등이있다. 이와 관련 시민참여의 중요성이 강조되고 있다. 리우선언의 ‘원칙 10’에서 환경과 관련한 절차적 권리를 명시하였고, 이러한 절차적 권리는 정보에의 접근, 의사결정과정에의 공공참여, 그리고 사법절차에의 접근 등이다. 인권법의 환경법에 대한 상대적 절대성을 통해 기후변화의 영향으로 인해 발생하는 인권의 침해를 좀 더 엄격하고 신중하게 다룰 수 있으며, 인권법의 프레임을 적용하면 국내법으로도 보호를 받을 수 있다. 국가는 기후변화에 대응하여 인권의 완전한 향유를 보장하기 위해 온실가스를 감축하고, 적극적으로 기후변화의 영향에 대한 행동을 취할 의무를 가진다. 더불어 노후 화력발전의 가동으로 인해 발생하는 미세먼지 저감정책도인권보장적 측면에서 적극 검토해야 한다. 파리협정에 대응하기 위한 최근 정부의 에너지 전환정책은산업적 측면과 더불어 인권보장 측면에서도 함께 검토하는 것이 바람직하다.
Abstract
Climate change is a matter of human rights as well as the environment. Many people around the world are already affected by climate change, affecting their lives, water, food, health, housing and other rights. Before the Paris Agreement was adopted in 2015, Greenpeace and Amnesty International urged the international community to take active and urgent action against climate change in terms of human rights. There has been a steady increase in awareness of the correlation between the environment and human rights that “climate change affects the quality of the environment, the quality of the environment is closely related to the flavor of basic human rights, and that climate change can threaten basic human rights.” The fact that climate change has a negative impact on the full flavor of human rights is widely recognized in the international community, and tangible human rights, especially affected by climate change, are life rights, health rights, housing rights, food rights and water rights. In this regard, the importance of civic participation is being emphasized. The Rio Declaration’s ‘Principles 10’ stated procedural rights relating to the environment, including access to information, public participation in the decision-making process, and access to judicial proceedings. The relative absoluteness of the Environmental Law of the Human Rights Act allows more strict and careful handling of human rights violations arising from the effects of climate change, and applying the frameworks of the Human Rights Act can also be protected by domestic law. The state now has a duty to reduce greenhouse gases and actively take action on the effects of climate change to ensure the full flavor of human rights in response to climate change. In addition, policies to reduce fine dust caused by the operation of old thermal power generation should be actively reviewed in terms of human rights security. It is desirable for the government to review its latest energy conversion policy to counter the Paris agreement in both industrial and human rights-guaranteed aspects.
