Abstract
The Hague Convention was enacted to protect children from parental abduction and illegal custody across borders. It is the purpose of the Convention to facilitate the expeditious return of illegally displaced children. In order to achieve this objective, the Contracting States shall respect the laws of other Contracting States and shall return all deprived children to the State of their habitual residence. The Convention applies to children under the age of 16, who must have a habitual residence in the Contracting State at the time of the seizure. Under the Convention, courts must determine the country of the child’s habitual residence. It is the State of habitual residence that determines the law applicable to whether or not there was an illegal movement in the case. It is also the State of habitual residence that determines the jurisdiction in which the child is returned. However, neither the Convention nor the Perez-Vera Report defined the concept of habitual residence. This paper mainly examines how US courts interpret and apply habitual residence under the Convention. U.S. courts would have tried to define habitual residence in a way that would help achieve the goals of the Convention and, if possible, find a uniform standard. From our point of view, it will be an opportunity to review the direction in which the meaning of the habitual residence is defined and applied. Let’s extract the meaning of habitual residence as determined by the US court and present a standard of uniform interpretation in practice. As a method for determining a child’s habitual residence, consider the child’s age first, if the child is mentally mature, consider the child’s will first, if the child is immature, consider the parent’s shared will, if the child is immature and there is no shared will of the parents, we propose a standard of action based on objective evidence by considering the place where the child has adapted. It is reasonable to consider all circumstances for the welfare of children as in the recent case of the US Supreme Court regarding the decision of the child’s habitualresidence under the Convention, but for a systematic approach, the order of consideration of factors for the decision of habitual residence is set.
