Abstract
“Doha Declaration” adopted in the 4th Ministerial Meeting of WTO suggests discussion of direction to contribute the establishment for fair trade law to give benefits to all members of WTO through trade liberalization based on active cooperation among nations. Especially, the awareness of environment problem and concerns on safety and health are reflected positively in the WTO aiming for trade liberalization, so the discussion on environmental issues are more critical and noticeable. As substantial discussions related the issues go on significantly based on the objective to pursuit sustainable development and environment protection stressed in the Doha declaration, it is very deeply required how to approach the environment issues which are likely to bring legal conflicts between nations. Moreover, environment related trades reflect the distinctiveness to be more likely to depend on the capability of nations including technologies and economic powers. If there is no the effort to accept legal values to apply in more substantively fair ways from the stage of negotiation to the application of provisions in the WTO law, eventually nations will have conflicts without any benefits. In this context, it is required to accept the basic values such as non-discrimination, reciprocity and substantive equity. The legalization of trade issues should contribute to set up the legal basis to get substantive benefits for all members in the WTO. That is, the issue on the discrimination measures by environment protection should be treated with fundamental legal values. To approach these issues, it is meaningful to analogize legal conditions taking account into the different economic developmental stage of each country. In other words, the review about the standard of judgement based on substantive fairness has the integral task to form more fair WTO law.
