1990년대 이후 우리나라 부당이득법의 발전에는 여러 원인이 있을 수 있겠지만, 그동안 학계에서 꾸준히 비교법적 연구를 통해 새로운 시각과 소재를 제공하였다는 사실도 그 하나에 해당한다. 무엇보 다도 독일의 학설과 판례의 소개를 출발점으로 하였던 부당이득법의 비교법적 연구는 근래 프랑스법 과 영미법의 연구로 확대되어 깊이를 더하고 있다고 보인다. 이러한 상황에서 네덜란드의 부당이득법 을 살펴보고 우리에 대한 시사점을 검토하는 작업은 나름의 의미를 가질 것으로 생각된다. 네덜란드 신민법전은 비교적 최근에 제정된 민법전으로, 그 작업에서 나타난 입법적인 평가와 그 해석론적인 운 용이 우리의 관점에서도 여러 가지 유용한 시사점을 줄 수 있다고 보이기 때문이다. 이 논문은 사적 맥락의 이해를 위해 네덜란드 신민법의 성립 경과를 간단하게 살펴본 다음(I. 2.), 네덜란드 신민법의 부당이득 규정을 번역해 소개한다(II. 1.). 이어서 한편으로 입법자료를 통해 그 의 미를 해명하고(II.2.), 다른 한편으로 문헌과 판례를 통해 그 구체적인 적용례를 살펴본다(III.). 마지막 으로 네덜란드 부당이득법이 우리 민법의 해석론과 입법론에 가지는 시사점을 요약하며 마무리한다 (IV.). 여기서 특히 입법론적으로 참고할 만한 어려 사항과 함께 삼면관계 부당이득에서의 해석론상 특징이 언급된다
Abstract
The development of the Korean law of unjust enrichment can be attributed to various factors. Among them, nobody could deny a great contribution the comparative researches, not least on French and German law, have offered. It should be meaningful at this juncture to expand our understanding by analyzing the Dutch law of unjust enrichment. The new Dutch Civil Code adopts some unique approaches on legal issues including unjust enrichment. It is hoped that an analysis of the Dutch law would help the Korean lawyers coping with interpreting and correcting their Civil Code. Beginning with a brief historical introduction into the Dutch Civil Code (I. 2.), the author presents a translated text of its articles on condictio indebiti and unjust enrichment (II. 1.). Then he elucidates their meaning by relying on legislative materials (II. 2.) and further describes some important cases decided by doctrine and courts applying the Dutch Civil Code (III.). In conclusion some lessons from the Dutch law are summarized (IV.). Noted are here especially several clues de lege frenda for the Korean Civil Code on the one hand, and the Dutch doctrine’s dealing with the indirect enrichment cases on the other.
