Abstract

In 2004, the United Nations General Assembly (UNGA) established Ad Hoc Open-ended Informal Working Group to study issues relating to the conservation and sustainable use of marine biological diversity beyond areas of national jurisdiction (BBNJ Working Group). The BBNJ Working Group has met consecutively from 2006 to 2015, discussing various issues ranging from the legal status of marine genetic resources, the use of area-based management tools, including marine protected areas, environmental impact assessments, capacity-building and the transfer of marine technology, which were normally referred as the ‘four main package’ deal. Eventually, the UNGA decided to develop an international legally binding instrument under the United Nations Convention on the Law of the Sea (UNCLOS) on the conservation and sustainable use of marine biological diversity in areas beyond national jurisdiction (BBNJ Agreement) in 2015. To that end, prior to holding an Inter-governmental Conference, it decided to establish a Preparatory Committee, to make substantive recommendations on the elements of a draft text of the BBNJ Agreement, taking various works conducted by the BBNJ Working Group into consideration. The Preparatory Committee held two sessions each in 2016 and 2017, and adopted its final report on July 31, 2017. Besides the ‘four main package’ deal, other issues such as general principles, international cooperation, internal organs and dispute settlement were also being dealt in its final report, but the significant progress has not been made due to the different views between developed and developing states. Particularly, regarding the issue on dispute settlement, the Preparatory Committee recommended to draw on the existing dispute settlement procedures, such as those of the Charter of the United Nations and the UNCLOS, but without providing any specific modalities for settling disputes. Therefore, this paper closely examines the elements that should be taken into account in designing the dispute settlement procedure under the BBNJ Agreement.
