Abstract

An issue of an employment discrimination based on LGBT’s sexual orientation in Korea tends to remain dormant under the circumstance of our society with a strong bias toward LGBT. However, as we have seen a recent controversy over a transgender’s military service in Korea, this issue might get into a furious dispute in near future. When an employment discrimination based on LGBT’s sexual orientation happens, sexual minority could feel difficulty in finding out the scope of the law under the traditional normative system with a concrete gender distinction. Solving this difficulty, it is desirable to legislate the prohibition of discrimination on the basis of LGBT’s sexual orientation for securing their employment and protecting their rights as human. However, a real legislation work including the prohibition of discrimination on the basis of LGBT’s sexual orientation must face off a hard controversy and resistance within our community. Then, what could be an effective solution to the problem of an employment discrimination based on LGBT’s sexual orientation? Bostock v. Clayton County in the U.S. Supreme Court could provide a clue to above question. This article mainly focused on reviewing the arguments made by both the Court opinion and two dissenting opinions in Bostock v. Clayton County. The Court opinion held that an employer violates Title VII of Civil Rights Act, which makes it unlawful to discriminate against an individual “because of” the individual’s sex, by firing an individual for being homosexual or being a transgender person. The Court opinion has a monumental meaning in setting a precedent by arranging the conflicting the lower courts’ interpretations concerning “because of sex” in Title VII of Civil Rights Act. Although both the Court opinion and two dissenting opinions cited Jutice Scalia’s textualism, it is interesting that the interpretation of each opinion was completely different. Due to the differences between the Court opinion and two dissenting opinions with regard to the ruling, the arguments of each opinion can present to us a heated discussion about the view of understanding a general and/or a public meaning of the law as a language and the role of the court as an interpreter of the law.
