노동자 중심의 디지털 무역정책에 관한 소고 - 디지털무역협정상 디지털 포용을 중심으로 -

‘2023 무역정책 의제 및 2022 연간보고서’에서 미국은 ‘노동자 중심의 무역정책’을 최우선으로 선정했다. 미국은 무역협정을 통해 미국 노동자들에게 ‘공정 경쟁의 장’을 마련하고자 할 뿐 아니라, 디지털 무역이 노동자에게 미치는 영향까지 파악하고자 한다. 이렇듯, ‘무역과 노동’의 연계 문제는 ‘디지털 무역과 노동’ 간의 연계까지 확대되고 있고, ‘영국-싱가포르 디지털경제협정’에 있는 ‘디지털 포용’ 조항에 노동 관련 내용이 포함되는 결과로 이어지고 있다. 따라서 본고는 무역정책에 노동을 연계시키면서 FTA 노동조항을 발전시켜 온 과정을 검토하고, 디지털 포용의 개념과 함께 등장한 디지털무역상 노동 관련 조항을 통해 향후 디지털무역협정에서 어떠한 방향으로 노동 관련 조항이 발전해 나갈 것인지를 살펴보고자 한다. 각국은 자국의 무역정책을 노동 문제와 긴밀히 연계시켜 다루어 왔고, 이를 자국의 FTA에 반영했다. 미국 및 EU를 중심으로 FTA에 정교한 노동 관련 조항을 추가하고 강력한 이행메커니즘을 수립하는 경향이 확대되는 한편, 이를 기반으로 한 노동 관련 분쟁도 증가하고 있다. 한편, DEPA뿐 아니라 ‘영국-싱가포르 디지털경제협정’도 ‘디지털 포용’을 규정한다. 특히 디지털경제에 종사하는 노동자의 양질의 작업조건을 촉진하기 위한 노동정책의 중요성을 강조하고, 디지털무역에 종사하는 노동자의 보호 촉진을 국가 간 협력 사항으로 추가하고 있다. 이와 같은 배경에서 AFL-CIO가 ‘노동자 중심의 디지털무역 의제’ 보고서를 통해 디지털무역협정에서 노동자, 개인정보보호 등을 위한 정부의 규제 권한 확보, 디지털 오프쇼어링 방지 등을 지적한 점은 유의미하다. 본고는 각국의 국내법 집행에 방점을 두는 FTA 노동조항만으로는 노동자 보호에 미흡하므로, 디지털무역협정에서 ‘디지털 포용’과 연계하여 별도의 노동조항을 채택하여야 함을 제안하였다. 인권 중 하나인 노동권이야말로 인권에 근간을 두는 ‘디지털 포용’과도 일맥상통한다는 점에서 노동 관련 법령의 집행강조 측면보다는 디지털 포용과 협력의 측면을 강조하는 디지털무역협정상 노동조항을 설계할 필요가있다.
Abstract
In the ‘2023 Trade Policy Agenda and 2022 Annual Report’, the United States prioritised ‘worker-centred trade policy’. Not only does the U.S. want to create a ‘level playing field’ for U.S. workers through trade agreements, but it also requires to understand the impact of digital trade on workers. The issue of ‘trade and labour nexus’ is also extending to the nexus between ‘digital trade and labour’, leading to the inclusion of labour-related provisions in the ‘digital inclusion’ clause of the Singapore-UK Digital Economy Agreement. This article examines the development of labour provisions in FTAs as a result of the linkage of labour to trade policy, and explores how labour provisions in digital trade agreements, alongside the concept of digital inclusion, may be improved in the near future. Countries have closely linked their trade policies to labour issues and reflected in their FTAs. The trend of adding elaborate labour-related provisions and establishing strong enforcement mechanisms to FTAs, especially in the US and EU, has been growing. Further, the number of labour-related disputes has increased. In addition, the DEPA and the Singapore-UK Digital Economy Agreement also provide for ‘digital inclusion’, specifically highlighting the importance of labour policies to promote decent working conditions for workers in the digital economy, and adding the promotion of protections for workers in digital trade as an area of cooperation between the parties. Against this backdrop, it is important to note that the AFL-CIO, in its report ‘A Worker-Centred Digital Trade Agenda’, has also highlighted the importance of securing government regulatory powers to protect workers’ privacy, and prevent digital offshoring in digital trade agreements. The report suggests that FTA labour clauses, which focus on enforcement of national laws, are insufficient to protect workers, and that separate labour clauses should be adopted in digital trade agreements in line with ‘digital inclusion’. As the right to work, which is one of the human rights, is in line with digital inclusion, which is also based on human rights, it is necessary to design a labour clause in a digital trade agreement that highlights the aspect of digital inclusion and cooperation rather than emphasizing the enforcement of labour-related laws.
