최근 글로벌화, 지식기반경제, 급속한 기술혁신 등으로 특허정책 및 전략의 중요성이 커지고 있다. 하지만 국내에서는 아직 특허정책(patent policy)에 대한 명확한 개념이나 원칙, 정책수단 등에 대한 경제 이론적 기반이 없이 진행되고 있다. 이에 본 연구의 목적은 특허정책에 대한 경제적 측면에서의 기반을 제공하는 것이다. 먼저 특허정책을 “정부가 특허제도의 목적을 극대화하기 위해서 제도, 법 및 기관을 디자인하고, 이를 기반으로 일련의 특허관련 활동들을 수행하는 정책”으로 정의하고, 이를 지식재산권정책, 기술정책, 산업정책 등과 구분한다. 특허정책의 경제적 당위성과 관련하여서는 외부성, 특허의 공공재적 성격, 불확실성 때문에 초래되는 특허시장실패(patent market failure) 현상을 분석한다. 사회적 후생을 극대화하기 위한 특허정책의 수립원칙으로서 특허법 제정 및 적용 측면에서 비절대주의, 반차별화, 학습의 원칙, 정책의 활용 측면에서 실현가능성과 권리이양의 원칙, 그리고 정책의 효과성 측면에서 부가성과 단순성의 원칙을 제안한다. 또한 특허정책의 수단을 특허제도 측면, 특허출원 측면, 특허심사 측면, 특허의 활용 측면, 특허의 관리 측면 등으로 분류하여 각 측면에서의 쟁점과 구체적인 정책수단 및 프로그램들을 소개한다. 그러나 본 연구는 특허정책에 대한 실험적인 경제적 분석이므로 특허정책에 대한 연구목적이나 정책수립목표에 따라서 접근방법 및 내용이 달라질 수 있다.
Abstract
Recently, the importance of patent policy and strategy is increasing due to knowledge-economy, globalization, and rapid technological innovation. In Korea, however, the economic basis for clear concept, principles, and measures for patent policy is week. This paper examines the economic aspects of the patent policy. First of all, we define the patent policy as “the policy established and implemented by the government to design systems, laws and institutions to maximize the purpose of the patent system and to carry out a series of patent-related activities.” The paper distinguishes the patent policy from the intellectual property rights policy, the technological policy, and the industrial policy. As for the legitimacy of the patent policy, we analyze the patent market failure caused by externalities, public good, and uncertainties. As principles of establishing a patent policy to maximize social welfare, we propose nonabsolutism, antidiscrimination, learning, administrability, devolution, additionality, and simplicity. Based on the scope of patent policy, we classify various patent policy tools being presently implemented by the Korean government. However, since this study is a exploratory economic analysis of patent policy, the approach and contents of patent policy can be varied according to the research agenda and policy targets.
