영국 교원단체교섭의 체계와 의제에 관한 연구

지금까지의 영국 교원노사관계의 연구는 노동기본권에 대한 법체계가 어떻게 구성되어 있는지를 중심으로 매우 제한적으로 소개해 왔으며, 교섭의제에 대한 연구는 전혀 이루어지지 않았다. 본 연구는 영국의 교원노사관계에 대한 구체적인 사례연구를 통해 우리나라의 교원노사관계에서 갈등 요인으로 작용하고있는 단체교섭의 의제 및 대상이 어떻게 설정되어야 하는가와 영국 교원의 교섭체계가 가지는 시사점을 분석하고자 한다. 우리나라의 교원노사관계가 10년이라는 짧은 역사를 가지고 있는 반면 영국은 100년이 넘는 교원노사관계의 역사를 가지고 있다. 영국의 교원 노사관계의 특징 중 하나는 과거 다수의 교원노동조합과 사용자단체가 참여하는 중앙 집중적 직접교섭 방식에서 현재는 제3기구인 교원노사조정기구(School Teachers’ Review Body, STRB)를 통한 간접교섭 방식으로 변화하였다는 것이다. 또한, 영국사례를 통해 우리가 눈여겨볼사실 중 하나는 2003년 이후 2010년까지 노동당 정부에서 유지되어 온 교육정책 전반에 걸친 사회적 협의기구인 ‘사회적 파트너십(Social Partnership)’의 운영이다. 단일 사업장의 교섭의제 차원이 아닌 교육정책의 입안과정에서 노동조합, (지방)정부, 사용자단체가 참여하는 사회적 파트너십의 운영을 통해 수시로노동조합이 교육정책에 대해 의견을 피력할 수 있는 협의채널을 유지했다는 것은 상생의 노사관계 구축을 위해 유의미한 시사점을 가지고 있다. 이는 영국정부가 교원을 포함해 영국 공공부문에서 노동조합이 가능한 다양한 의사결정과정(전국단위 및 지역단위 포함)에 참여하는 것을 독려하고 있는 사실과도 접맥되어 있다.
Abstract
The purpose of this paper is to examine the collective bargaining structure of school teachers in Britain. The paper also attempts to suggest the ways in which the collective bargaining agenda, which often causes conflict between school teachers' trade unions and the government in Korea,should be established. The previous studies on school teachers' industrial relations in Britain has narrowly focused on the contents of the relevant laws and the fundamental labour rights of school teachers, but never dealt with detailed collective bargaining processes and collective bargaining agendas. While the direct collective bargaining between employers and school teachers' trade unions at the local level plays crucial role, school teachers' pay and conditions are determined by the Schools Teachers'Review Body(STRB) at the national level. The pay determination mechanism throughout the STRB contributes to stabilizing the industrial relations in the education sector in Britain since employers and trade unions in the sector are able to avoid direct conflict regarding the determination of school teachers' pay, which is often one of the largest causes of labour conflict in general. With a history of more than a hundred years, the British experience on school teachers' industrial relations could provide meaningful insights and lessons for Korea. This study may contribute to finding alternatives for solving a serious industrial conflict between school teachers trade unions and the government in Korea.
