교원노사관계 불공정 관행 사례연구: 정부와 교원노조간 관계를 중심으로

교원노동조합법이 시행되어 교원들의 단결권과 단체교섭권이 보장되면서 교원들의 근로조건 개선을 통한 사회적, 경제적 지위향상을 기대할 수 있게 되었다. 2011년도부터는 단체교섭에서 창구단일화가 필요 없게 되어 보다 원활한 단체교섭이 이루어질 수 있는 기반이 마련되었지만, 창구의 다양화로 각 교육청은 단체교섭의 어려움을 겪고 있기도 하다. 이처럼 교원의 노동기본권이 보장된 지 상당 시간이 지났음에도 불구하고 단체교섭의 진행이나 내용상 여러 가지 문제점을 안고 있다. 특히 교원노사관계에서는 교원노조법상 단체교섭의 대상과 범위가 명료하게 규정되어있지 않아, 이를 두고 당사자 간 해석의 차이로 다양한 단체협약이 나타나 또 다른 문제를 안고 있는 것이 현실이다. 이러한 차원에서 교원노사관계에서 정부와 교원노조간의 불공정 관행이 무엇이며 어느 정도 나타나고 있는지를 분석하고 교원노사관계 선진화를 위한 정책적 시사점을 제시하고자 한다.
Abstract
As the introduction and operation of teachers union law, teachers unions have got the right to organize and the right to collective bargaining. Due to this kind of guaranteed rights, teachers anticipated an advance in socio-economic status by the improvement of labor conditions. According to the abolition of unification of negotiation parties in 2011, there can be prepared a better basis for the effective collective bargaining. For all that kind of advantageous changes, each provincial office of education is undergoing difficulties in negotiating with various teachers unions. Like this, many years have passed since the teachers’ fundamental rights of labor were introduced, there are still many problems in the processes and contents in collective bargaining. In this context, this study intends to analysis what is the unfair practices in the labor relations between government and teachers union, how much degree of unfairness two parties(government and teachers unions) feel in the process of collective bargaining, and suggest some useful policy implications to develop labor relations between government and teachers union.
