Abstract
The subject of protection under copyright law is works. A work refers to a creative work that expresses human thoughts or emotions. Therefore, a creative work that expresses human thoughts or emotions through “sound” can be protected by copyright law as a music work. Music works are creative expressions conveyed in continuous sounds that can be perceived through hearing, reflecting the unique characteristics of musical works. Music works are valued for their creative expression through “sound.” As expressions that directly appeal to emotions through hearing, they must be comprised of combinations of sounds, which inherently have certain limitations. Among the three elements of music-melody, rhythm and harmony, the most room for creative expression lies in melody. These unique characteristics of musical works should also be reflected in determining copyright infringement of music works. The requirements for copyright infringement are not stipulated in copyright law itself but are established by precedents and academic theories. By reflecting the unique characteristics of music works in each infringement requirement, a judgement theory for music copyright infringement can be formed. This study aims to diagnose and revise the existing legal theory by analyzing the precedents of musical works accumulated in Korean courts so far. Infringement of musical works is established when three tests are met: Test①-the plaintiff’s musical work must be a creative expression; Test②-the infringer must have used the plaintiff’s musical work ‘based on’ it; Test③-the plaintiff and the defendant’s musical work must be substantially similar. Regarding Test①, to be established as a musical work, it must be a creative expression through melody, rhythm, and harmony, focusing on melody to determine whether it is a creative expression. The legal doctrine of idioms should be excluded in the case of music works, as idioms are ambiguous in meaning, and idiomatic expressions cannot exist in melody. Regarding Test②, it is important to note that even if the plaintiff’s musical work is similar to a prior work, it does not necessarily preclude the possibility that the defendant’s musical work is accessed on the plaintiff’s. The access and striking similarity judgment should consider both the plaintiff’s and defendant’s musical works. Since the access and striking similarity is not easy to objectively reveal, it is not desirable to impose an excessively high burden of proof. According to the basic legal doctrine set forth by the court, it is sufficient to have a considerable possibility of seeing or coming into contact with the plaintiff’s work. Additionally, care should be taken with concepts like unconscious access or the “duty of care to prevent unconscious infringement,” as they may inadvertently stifle creative activities. Regarding Test③, the judgement perspective should be centered on the expert perspective while maintaining a balance by considering the audience perspective. In judgment methods, a dissection approach should be the main focus, balanced with the total concept and feel test. For judgment criteria, emphasis should be placed on the qualitative test to determine how crucial a specific musical expression is within the entire musical work.
