Abstract

More than a year has passed since the WHO Director General declared in January 2020 that the outbreak of COVID-19 constituted a Public Health Emergency of International Concern. As of April, 2021, the accumulated number of coronavirus infection reached over 140 million worldwide. As an unprecedented global health crisis induced strict border control in international community in order to prevent the spread of coronavirus, the EU Member States undertook various measures including border closure. The closure of most border crossings particularly hampered mobility of asylum-seekers and refugees who are in need of international protection across the borders and eventually left them in a blind spot for protection. While international refugee law traditionally does not allow any derogation of obligation, international human rights treaties allow derogation or limitation clauses on certain rights under exceptional circumstances. However, it does not imply that such derogation or limitation can be invoked without any restrictions. they must be based on laws along with legitimate purposes and proportionality. This paper examined whether various measures taken by the EU Member States in response to COVID-19 outbreak were consistent with international refugee law as well as international human rights law. A proper balance should be sought between a State's right of asylum and State's obligation of non-refoulment. It must be also noted that the principle of non-refoulment is not only State's non-derogable obligation, but more importantly an individual's right not to be returned to a country where such individual is likely to face persecution or serious danger. In September 2021, the European Commission proposed "The New Migration Pact on Immigration and Asylum" and emphasized the EU's solidarity. However, strengthening EU's solidarity particularly in times of COVID-19 may lead the EU to take more closed policies, thereby weakening the policy to protect asylum-seekers and refugees.
