Abstract

The protection of refugees is a human rights issue, whereas the processing of refugee applications has traditionally been considered a matter of national sovereignty. However, sovereignty is confined to the nation-state, whereas human rights extend beyond national borders due to their universal and abstract nature. Consequently, human rights and sovereignty have been examined separately, with no consideration of their overlap. Universal human rights for foreigners, including protection for refugees, must be respected. However, the intersection between sovereignty and human rights has been obscured due to the emphasis placed on the universal nature of human rights. Sovereign states may protect refugees based on domestic law or accept international human rights protection as part of their duty. Recognizing the possibility of integration between sovereignty and human rights could lead to progress in both refugee protection and the improvement of refugee systems.
