Abstract

This study provides a comparative legal analysis of child and youth protection standards embedded in the European Union’s four core digital regulatory frameworks: the General Data Protection Regulation (GDPR), the Digital Markets Act (DMA), the Digital Services Act (DSA), and the Artificial Intelligence Act (AI Act). The findings reveal that the EU has established a multilayered regulatory architecture spanning data protection to AI ethics, progressively strengthening safeguards for minors through measures such as bans on profiling-based advertisements targeting children, restrictions on manipulative AI systems, and mandatory risk assessments by digital platforms. The GDPR ensures data protection, the DMA promotes market fairness, the DSA enforces platform accountability, and the AI Act advances algorithmic responsibility and ethics—altogether reinforcing minors’ digital rights through an incremental regulatory model. Notably, the DSA explicitly prohibits profiling-based advertising to minors and requires child-friendly service design, while the AI Act bans AI systems that exploit children’s vulnerabilities. However, key challenges remain, including inconsistent age definitions across laws, regulatory overlap, and technological enforcement limits. This study argues that Korea should draw lessons from the EU model by developing a “K-Digital Child Protection Framework” through unified guidelines, technology standardization, and a strengthened public–private cooperative governance system.
