가정폭력 등 관계폭력에 대한 회복적 사법의 적용가능성

회복적 사법과 관련된 연구들은 초기에는 전통적인 형사사법과 대비하여 회복적 사법의 특성과 장점을 부각시키는 데 많은 비중을 두었지만, 최근에 와서는 그것의 적용한계 및 문화, 인종, 젠더가 미치는 영향 등에 대해서도 관심을 기울이고 있다. 특히 회복적 사법과 젠더문제가 교차되는 영역인 가정폭력과 성폭력 범죄에 대한 회복적 사법의 적용은 페미니스트 관점에서 그 적정성에 대한 의문이 제기된 이래 찬반논쟁이 계속되고 있다. 높은 재범률을 놓고 볼 때 전통적인 형사사법에 의한 대응의 실패라고도 할 수 있는 가정폭력이나 성폭력과 같은 관계폭력에 대해 우리 사회가 그 대응책을 다각도로 모색한다는 측면에서 회복적 사법의 적용가능성을 본격적으로 검토할 필요가 있다. 가정폭력이나 성폭력과 같은 관계폭력범죄에 회복적 사법을 적용하는 경우 폭력의 특성상 문제점이 따르는 것은 사실이지만, 그것은 회복적 사법이 갖는 사적 메카니즘이나 약한 제재 자체에 있다기보다, 근본적으로 성폭력이나 가정폭력과 같은 여성에 대한 남성의 폭력에 관한 이론적 기초가 미흡한 점에서 비롯되는 것들이다. 그러므로 그런 회복적 사법의 취약성을 파악하고 여성주의 이론, 비판적 인종적 여성주의 이론, 가정폭력과 관련한 사회과학적 연구, 구타하는 남성에 대한 프로그램의 이론적 토대를 통해 보완함으로써 회복적 사법의 적용에 있어 좋은 해결방식으로 삼을 수 있다. 가정폭력과 같은 관계폭력에 회복적 사법을 적용할 때는 폭력의 특성상 내재적인 위험성을 고려해야 하는데, 이 글에서는 그러한 위험성의 예로 폭력배경의 은폐, 피해자의 안전에 대한 위험, 가해자에 대한 책임부과의 불명확성, 피해자의 경미한 자기결정능력 등을 체계적으로 분석하였다. 그리고 위험성을 배제하기 위해서 회복적 사법절차에서 고려해야 할 몇 가지 원칙들, 즉 폭력구도의 이해, 가해자와 피해자의 대면문제, 화해․사과 또는 가해자의 책임문제, 관계폭력에서의 회복적 사법의 목표 등을 정리하였다.
Abstract
Contradictory opinions on the application of restorative justice to domestic violence have been reported in recent published articles. Some people have claimed that the restorative justice should be applied to domestic violence or violence against women. Other people have advocated that it should not be applied to domestic violence, because they have concerned that victims could be re-victimed in restorative justice practices. They have also concerned that the application of restorative justice to those violence could be too weak measures to prevent crimes. The inconsistency of the opinions prompted to write this article. This paper claim that restorative justice can be applied to all types of crimes. Based on that promise, it can also be applied to the violence against women and families, as far as the characteristics of crimes is properly considered in the application. Domestic violence is commonly recurrent, may escalate over time, and may affect a number of people beyond the primary target including children, other family members and supporters of the victim. For those reasons, the safety of the victims must be a primary consideration. No therapeutic work can possibly succeed if safety has not been adequately secured. Common outcome of restorative justice include restitution, compensation, service to victims and apologies. However these outcomes may be less appropriate in domestic violence matters. Outcome plans for domestic violence should require a significant commitment of resources over time in order to respond to a victim’s concerns. In conclusion, carefully planned and managed restorative justice practices may be effective in diminishing domestic violence.
