Abstract
While the number of applications for refugee status in Korea has rapidly increased since the Refugee Act came into force in 2013, non-permanent members of the Refugee Committee under the Ministry of Justice have not been able to properly examine the increased appeal applications of negative refugee decisions. The number of people seeking asylum in Korea surpassed ten thousand, and public controversy erupted earlier this year when more than 549 refugee applicants from Yemen arrived at Jeju island through the visa waiver program. Following these events, the Ministry of Justice announced that it is planning to make the current non-permanent Refugee Committee permanent and ultimately establish a specialized refugee appeal tribunal by which the trial proceedings at the district court level could be skipped and the appeal processes expedited. Although efficiency becomes more important in a system burdened by many applicants, fairness executed by independent and competent decision makers must, nevertheless, be the ultimate goal. Considering the establishment of the refugee appeal tribunal is modeled after specialized administrative appeal tribunals systems operated in common law-governed countries, we must fully understand institutional and procedural mechanisms adopted to guarantee independence, competency, fairness and efficiency of the appeal procedure in those countries. With this in mind, this article aims to affirm that the current appeal procedure at Refugee Committee needs real reforms as it lacks independence, competency, fairness, and efficiency. It also shows what kinds of institutional and procedural mechanisms that guarantee independence, competency, fairness, and efficiency of the appeal procedure were adopted and how they were successfully operated in common law-governed countries like the U.S., Canada, Australia, and New Zealand. Ultimately, this article seeks to critically review the establishment proposal of the refugee appeal tribunal officially suggested by the Ministry of Justice and, based on the comparative research on systems of common law-governed countries, it seeks to suggest directions the reform of the current appeal system at Refugee Committee should take.
