‘자유’에 대한 법경제학적 소고

자유는 우리나라의 규범적 기초인 자유민주주의와 경제적 기반인 시장경제를 연결하는 교차점이며 사회 발전의 중요한 동력이다. 그러나 최근 여러 가지 사회적 이슈를 둘러싸고 나타나는 자유에 대한 논쟁은 오히려 사회 발전의 퇴행을 초래하고구성원의 행복(복지)을 저해하는 요인이 될 수 있다는 것을 보이고 있다. 시장에서의‘자유’와 자유민주주의 하에서의 ‘자유’는 특정한 사회적 아젠다에 대해 각자의 입장을 주장하기 위한 구호이거나 정쟁을 위한 논쟁점이 아니며 우리가 선택한 규범과제도 하에서 실체적으로 존재하는 국민적 합의(national consensus)의 시작이자 결과물이며 상호작용의 과정이다. 시장의 실패에 직면하여 경제학과 법학에 대한 통합적 접근을 시도한 제1기 법경제학의 관점은 유사한 구조적 상황에 처해있는 오늘날 적용 가능한 시사점을 갖고 있다. 이 글은 이러한 접근을 통해 의식적인 목표를 갖고 있는 유기체로서의 사회의성장을 가능하게 하는 자유의 본질적 요소로서의 책임성(responsibility)이 법학과 경제학 모두에 공통적인 요소임을 제시하고 이것이 우리나라의 국민적 합의인 헌법 규정에 의해 뒷받침됨을 보인다. 17세기 자유에 대한 담론에서 출발한 사회계약(social contract)과 사회적 대화(social dialogue)에 기반한 헌법적 선택(constitutional choice)은개인의 자유와 사회의 이익이 최적화(파레토 최적)되는 헌법경제학의 이론적 기반을제공한다. 이러한 논의를 기반으로 이 글에서 도출한 법경제학적인 관점의 자유에 대한 프레이밍은 ‘힘에서 규칙으로’, ‘규칙에서 규범으로’ 나아가는 과정이며 이는 모든국민이 구속되는(사용하는) 공공재(public goods)이자 합의의 결과물로서의 헌법, 그리고 그 합의의 주체인 개인 상호간에 끊임없는 소통과 상호작용의 과정임을 제시한다.
Abstract
Liberty is the intersection point of liberal democracy and market economy composing our society legally and economically. However the controversies about liberty arising around diverse social issues show that they could cause social regression and decrease the welfare of people in society. This paper demonstrates that liberty is not political slogan nor arguing point which hinders meaningful arguments insisting each own position around social agenda, but basis and outcome of national consensus and interactive process. Facing market failures, the integrative approach of law and economy from late 19c to early 20c has applicable instructions to the similar structural problems of present day. Through this approach this paper shows the ‘responsibility’ is the essential component of liberty commonly applying to law and economy, which enables the society to grow as conscious organism. And our constitutional provision supports this. Social contract and social dialogue which trace back to the discourse of liberty in the 17th century are pillars of constitutional choice of people in a nation. And this is the Pareto optimal process which pursues extension of interest of society and individuals. Based on this theories, this paper presents that the framework of liberty from the perspective of law and economy is the process, ‘from power to rule’ and ‘from rule to norm’, which can be achieved through continuous communication and interaction among people and constitution.
