우리나라는 수년 전부터 급격한 기술변화로 인한 고용관행의 변화를 겪고 있다. 이러한 상황에서 발생한 코로나19는 고용관행의 변화를 가속화하였다. 정형화된 직장에서 일하는 근로자에게 적용되는 종래의 노동법제는 포스트 코로나 시대의 변화에적절하게 대응하는 데에는 한계를 보이고 있다. 따라서 노동법제 및 정책 방향을 재설정할 필요가 있다. 다만, 이러한 정책의 변화가 일각에서 말하는 ‘유연화’로 귀결되어서는 아니된다. 또한 우리가 코로나19 상황에서 적나라하게 직면하게 된 심각한 문제들의 상당부분은 코로나19 이전부터 이미 알면서도 방치한 경우가 많다. 따라서 변화된 현실을 고려하면서 노동법이 본래의 목적을 수행할 수 있도록 고민해야 할 것이다. 이러한 관점에서 이 글에서는 근로자의 시간주권의 확대 필요성 및 이를 위한 제도개선 방안, 근로자의 이익대표제 개선 필요성 및 근로자대표제도의 개선방안, 직업능력개발 제도의 개선 필요성 및 개선 방안, 사회적 대화의 추진 방향 등을 제시했다.
Abstract
Employment practices in Korea have changed since many years ago due to rapid technological changes. COVID-19 arising from these circumstances accelerated the change in labor and employment practices. The current labor legislation, which applies to workers working in stereotyped workplaces, has limitations in responding appropriately to changes in Post-COVID era. Therefore, it is necessary to review and reset the direction of labor legislation and policies. However, such a change in policy should not result only in what some call "flexibility." Also, much of the serious problems that we face in COVID situation have often been known, but neglected before in COVID Era. We will have to consider the changed reality and contemplate so that labor laws can carry out their own purposes. From this point of view, the article presented the need to expand the time sovereignty of workers and improvement of the system, the need to improve the representative system of workers, the necessity and improvement of the vocational education and training system, and the direction of social dialogue.
