Abstract

This study aims to elucidate how psychoanalysis engages with the notion of "difference" through its critique of law. Previous scholarship has largely examined "difference" in psychoanalysis not in relation to law itself but with critiques of psychoanalysis, thereby focusing on the divergences or affinities between Deleuze and Derrida. Yet it must be recalled that both thinkers elaborated their concepts on the basis of a critique of psychoanalysis, rather than the other way around. Against this backdrop, the present study investigates how psychoanalysis treats difference by way of Badiou’s and ホi゙ek’s critiques of law. Three objectives guide this inquiry. First, the study examines Lacan’s conceptualization of law, considering how the call for the suspension of law leads to the ethics of psychoanalysis. Second, it analyzes the relationshipbetween law and transgression, addressing the dialectical vicious cycle it entails and the notion of drive as the point of its interruption, while also engaging with the Pauline and Joban figures that inform Badiou’s and ホi゙ek’s accounts of psychoanalytic ethics. Third, it turns to the theoretical divergence between the two thinkers in their respective approaches to subject(ivation). While Badiou emphasizes the event and the subject of fidelity that affirms multiplicity, ホi゙ek stresses the Lacanian analyst’s discourse and the invention of a new master-signifier. In short, both thinkers ultimately converge on the question of subjectivation, which concerns the conditions for transforming discourse as the structure of today’s social linkages.
