Abstract
Today, we should overcome the state of nature of the Internet (which causes reactive digital authoritarianism and hybrid warfare) with the construction of cosmopolitan norms and laws that can coordinate the various conflicts among individual rights and digital sovereignty. In this context, Kant’s Perpetual Peace, which suggests that public right comprises the republican constitution of each state, federation of free states, and the cosmopolitan rights of men, provides us with a useful theoretical framework. However, it must be reinterpreted from a contemporary viewpoint because the modes of conflict in cyberspace are different from that of the 19th century when Kant wrote Perpetual Peace. The purpose of this study is to examine the theoretical limitation and potential of Perpetual Peace in the era of digital revolution. This article can be summarized with the following dialectical propositions: Dichotomous application of the “definitive articles” of Perpetual Peace has no practical validity for today’s conflicts in cyberspace; contemplating the priori values, law principles, and humanitarian purposes of Perpetual Peace deepens our reflection on Internet governance; and when the application of the values, principles and purposes of Perpetual Peace extends beyond positive laws or political institutions to the very design of ICT systems and to the policies of non-state actors it can function as a critical theory for cybersecurity governance today. To prove these claims, the issues of security dilemma, digital sovereignty, and the conflict between the multistakeholderism and intergovernmentalism over the Internet governance are analyzed.
