칸트 영구평화론의 국제정치적 함의

최근 국제적인 영구평화를 모색하는 데 있어 칸트의 영구평화론에 대한 논의는 매우 중요하다. 이에 본 논문은 국제질서가 영구적인 평화체제로 나아가는데 있어, 근원적인 해답을 제공해 줄 수 있는 칸트의 영구평화론을 분석하고, 그것을 바탕으로 칸트 영구평화론의 국제정치적 함의를 모색하고자 한다. 칸트 영구평화론의 내용은 영구평화를 위한 예비조항과 영구평화를 위한 확정조항에 나타나 있는데 이를 정리하면 다음과 같다. 예비조항에서는 첫째, 장래의 전쟁에 대비하여 물자를 비밀리에 간직해 두고서 맺어진 평화조약은 이를 평화조약으로 인정해서는 안된다. 둘째, 어떠한 독립된 국가도 상속, 교환, 매수, 증여로써 다른 국가의 소유가 될 수 없다. 셋째, 상비군은 점차로 철폐되어야 할 것이다. 넷째, 국가는 대외적인 분쟁과 관련하여 어떠한 국채도 발행해서는 안된다. 다섯째, 주권개입의 금지로 어떠한 국가도 다른 국가의 제도와 통치에 대해 폭력으로써 개입해서는 안된다. 여섯째, 어떠한 국가도 타국과의 전쟁에 있어서는 장래의 평화에 대한 상호간의 신뢰를 불가능하게 하는 어떠한 적대행위도 행해서는 안된다. 다음으로 확정조항에서는 첫째, 각 국가에 있어서의 시민적 체제는 공화적이어야만 한다. 둘째, 국제법은 자유스런 여러 국가의 연맹조직을 토대로 해야 한다. 셋째, 세계시민권은 보편적인 우호관계의 조건에 의해서 제한되어야 한다. 이를 토대로 볼 때 칸트 영구평화론의 국제정치적 함의에 대한 실천적 고려는 국제평화와 안전유지를 목적으로 하는 국제연맹과 국제연합, 유럽의 실천적 형태는 유럽연합이라고 할 수 있다. 그러나 칸트의 영구평화론은 나름대로 한계점을 지니고 있다. 첫째, 과연 인류가 발전하면서 계속해서 진보할 수 있는 존재인가 하는 의문이다. 둘째, 국가간의 전쟁을 야기시키는 원인파악에 있어 국제정치의 구조를 어떻게 보느냐 하는 것이다. 셋째, 국내 수준과 국제 수준에서 보다 평화로운 체제를 위한 방법이 무엇인가에 대한 해답을 찾는 것이다.
Abstract
Recently, international society carry out various projects to establish peace. Therefore the purpose of this paper is analyze Kant’s Perpetual Peace and it studies political significance with the international system. The preliminary articles: ① no treaty of peace shall be held valid in which there is tacitly reserved matter for a future war. ② no independent states, large or small, shall come under the dominion of another state by inheritance, exchange, purchase, or donation. ③ standing armies shall in time be totally abolished. ④ national debts shall not be contracted with a view to the external friction of states. ⑤ no state shall by force interfere with the constitution or government of another state. ⑥ no state shall, during war, permit such acts of hostility which would make mutual confidence in the subsequent peace impossible. The definitive articles: ① the civil constitution of every state should be republican. ② the law of nations shall be founded on a federation of free states. ③ the law of world citizenship shall be limited to conditions of universal hospitality. Ultimately, Kant's Perpetual Peace have effects on international organization such as League of Nations, United Nations, European Union. However, It has limitations which are international political structure for war and peace, peaceful system between universal and domestic.
