Abstract

Recently the use of the Social Media as means of communication is extending steadily all over the world. As the Social Media is becoming popular, the possibility that disputing parties use the Social Media information as the evidence will increase in the litigation. The problem is that the characters of the Social Media was not reflected in established procedure. In spite of lots of discussion and the revision of law of electronically stored information, there is new discussion about the Social Media information in U.S.A. This is because the Social Media has some additional characters such as private, sharing, and existence of service provider. So far, the Social Media did not make problems in the civil procedure in Korea. However, judging by the tendency of the Social Media we need to review the discussion of U.S.A. to prevent the possible problems in Korea. This article reviewed the characters of the Social Media and the problems, and the discovery issues of the Social Media in U.S.A. and the several improvements of the civil procedure in Korea. First it is necessary to deny the admissibility of evidence of the illegally gathered the Social Media information. Second the court should render ex officio a ruling of preservation of evidence actively concerning the Social Media, sanctions against spoliation of evidence should be reinforced, and requirements for sanctions should be modified and introduction of exemption provisions should be considered. Third the guideline to protect the privacy in examination of the Social Media evidence is necessary. Forth it is necessary to amend the presumption by law concerning the Social Media information and help judges to have a specialty in evaluating the Social Media information as evidence institutionally.
