Abstract
Freedom of fishery in the high seas has been a traditional principle in international law of the sea. However, this principle is under a pressure of abrogation because of development in marine science, extension of maritime jurisdiction of coastal states through EEZ, and worsening marine pollution. New international fishery regime is needed for the sustainable fishery in the future. The 1982 United Nations Convention on the Law of the Sea(UNCLOS Convention) adopted at the 3rd United Nations Conference on the Law of the Sea introduced new conservation and management system for marine living resources, while it based its framework on the traditional zonal management. However, the newly introduced system was far from integrated management approach and fall short of revolutionary conservation measures. More full-scale introduction of the conservation and management measures have been attained by new multilateral conventions and practices of states. Especially the 1995 Fish Stock Agreement adopted precautionary principle and compatibility principle, while the agreement considered the role of the Regional Fishery Management Organizations(RFMOs) important. Establishing effective implementation and compliance system is also necessary for more efficient conservation and management of marine resources. So, various methods for more efficient compliance are invented and included in new international fishery regime. Flag state jurisdiction is stressed to contribute to conservation of living resources, port states are allowed to visit and inspect IUU fishery vessels, and inspection at sea is partly permitted. These changes in international law of fishery were adopted by the 1995 Fish Stock Agreement and various FAO regulations and received by RFMOs
