이글은 루만의 현대사회 이론에서 공공성 목표의 달성이 왜 가능하지 않는 지에 대한 근거를 살펴보고 이를 비판적으로 고찰하고자 한다. 고찰 결과에 따르면, 루만이 현대 사회를 다수의 독립적이고 자기폐쇄적인 부분 기능 ㅊ계로 구성된 다중맥락 사회로 파악한다. 이 사회 현태에 사회 통합의 문제는 부분 체계로의 개인의 포괄 문제로 전환되었다. 또한 후기에 와서 루만은 다중맥락사회에서 배제 문제가 구조 문제로 전환되었다. 또한 후기에 와서 루만은 다중맥락사회에서 배제 문제가 구조적인 성격을 갖고 있으며, 따라서 심각한 사회문제를 야기할수 있음을 지적하였다. 하지만 공공성 실현의 전략 측면에서 루만은 정치 체계의 개입은 사회를 구성하는 자기준거적 체계의 상호폐쇄성 때문에 더 이상 효과가 없을 것으로 진단하였다. 이에 따라 루만은 공공성 실현을 위한 복지영역으로 두가지 형태를 제시하고 있다. 첫ㅉ, 공공영역으로 복지영역은 정치적 포괄을 위해 정치 체계의 부분 영역으로 구축될수 있다. 둘째, 복지영역은 대리 포괄을 위해 이차적 분화형태인 사회사업 체계의 구축에 의해 보조된다. 이러한 루만의 사회 통합 이론은 지나친 조종 회의주의로 이론적, 경험적으로 수용되기 어렵고 자유주의적인 국가와 친화적인 것으로 나타났다. 그럼에도 불구하고 루만의 포괄과 이차적 분화의 개념은 복지국가 이론의 발전을 위한 중요한 단초를 제공한다.
Abstract
This study aims to observe critically, why in the modern social theory of Niklas Luhmann it is impossible for the political system to achieve the social integration. According to the study, Luhmann regards the modern society as the Multi-Center-Society, which is composed of a number of independent and self-closing functional systems. In this society form the problem of social integration is converted to the problem of inclusion of individuals in the subsystems. The late Luhmann points out, that also in the Multi-Center-Society the exclusion has a structural characteristic in the society and, therefore, leads to serious social problems. In terms of the realization of publicness Luhmann diagnoses however, that the strategic intervention of the political system would not be effective because of the system’s self-closure. Accordingly, for the realization of publicness Luhmann presents two forms of the welfare sector. First, the welfare sector as public sector can be constructed as the part area of the political system. Second, the welfare sector is complemented by the system of the social worker, which is constructed as form of independent social system resulted from the secondary differentiation. Luhmann is criticized that his regulation skepticism is hard to be accepted theoretically and empirically and closes to the idea of the liberal state.
