폭우, 폭설 등 기상이변이 더는 이변이라고 할 수 없을 정도로 지구온난화는 지구환경을 위협하고 있다. 특히 지구온난화에 크게 영향을 미치고 있는 기업계에는 심대한 도전이 되고 있다. 현재의 경제상태, 환경변화에 관한 관심증대 등은 많은 투자자 및 소비자 그룹들로 하여금 기후변화와 관련하여 기업에 영향력을 행사하기를 원하고 있다. 기후변화에 관한 논의가 계속적으로 확대될 것이라는 점과 정부와 기업 관계자들의 정책과 관행은 그에 따를 것이라는 점은 명백한 것으로 보인다. 자본시장에서 투자원리에 기후변화에 관한 문제가 반영된다면 자본시장의 중심부에서 지구환경을 개선할 수 있는 가능성이 열린다고 할 것이다. 이 논문은 화석연료산업의 활동이 이산화탄소의 발생을 증가시키고 그로 인해 기후변화에 크게 영향을 미치는 것으로 인식되고 있는 상황에서 화석연료산업에 대한 자본회수운동이 가져올 법리적 메커니즘을 검토한 것이다.
Abstract
For a long time, SRI movement was regarded by mainstream financial institutions as a subversive, fringe sector. This article seeks to clarify the impact of fiduciaries' investment duties in the pension fund sector on SRI. Fiduciary duties of pension funds are evolving again to reflect impacts of environmental and social concerns on corporate financial performance. In these days the financial world is belatedly learning that good environmental performance can spur better financial performance. Failure to consider and act on environmentally and socially related information is not prudent in the financial sense of the word and should not be treated as prudent in the legal sense either. This Article explores whether legislations passed during the anti-apartheid divestment campaign can serve as a model for trustees of public pension funds to divest their holdings in fossil fuels. The Baltimore analysis gives some guidance as to this divestment would be a breach of their fiduciary duties, but this analysis does not answer the question of this issue. The risks of climate change become clearer. Therefore fiduciary duties cannot prohibit divestment.
