고령범죄자의 치매와 형사정책에 관한 고찰

A Study on Dementia and Criminal Policy in Elderly Criminals

초록

우리나라의 경우 추정치매환자의 추이로 65세 이상의 추정치매환자수는 2020년 약 84만명, 2030년 136만명, 2040년 217만명, 2050년에는 300만명을 넘을 것으로 예상되고 있다. 고령자범죄 발생률이 가장 높은 범죄군은 재산범죄이며, 그 다음은 교통범죄, 강력범죄(폭력), 강력범죄(흉악범죄)으로 증가하고 있다. 각국의 치매환자와 범죄행위에 관한 연구에서도 치매유형 중 전두측두엽 치매의 범죄발생율이 가장 높게 나타났으며, 치매노인이 저지르는 범죄유형은 절도, 교통사고, 성범죄, 무단침입 등의 순서로 나타났다. 우리나라의 경우 치매범죄자의 형사책임과 관련해서 치매환자들의 뇌 MRI는 두부외상, 뇌졸중, 치매로 인한 뇌위축성의 변화를 뚜렷이 보여주고 있음에도 불구하고 치매를 정신장애 또는 책임능력과 관련하여 판시한 대법원 판례를 찾아볼 수 없다. 치매진단의 정확성과 유형별 특성에 따른 진단방법의 다양성과 관련해서 고령범죄자를 위한 법의학 정신감정과 정신과 서비스계획은 젊은 연령의 범죄자의 정신장애의 유형과 상병률의 추정치에 근거하여 설계될 수 없다. 치매 진단 이후의 처우에 대해서도 전략적으로 예방적 처우 내지 사회안전망 구축과 관련된 전문적 치료를 수반한 치료서비스가 요구된다고 할 수 있다. 더 이상의 치료가 가능하지 않고 치료감호 등의 처우가 무용한 중증의 치매범죄자에 대한 처우는 보호관찰의 특별준수사항으로서 보호관찰관의 감독하에 치매전문병원에서 격리・치료를 받을 것을 명령하는 처우로 전환하는 것이 필요하다고 할 수 있다. 사전적으로 전두측두엽치매와 관련된 정확한 진단을 위한 정신감정 서비스 제공 및 복합위기 차단을 위한 알코올 제한 프로그램 도입은 치매유병률이 증가하는 현상에 필수적으로 취해야 하는 형사정책적 접근방안이라고 할 수 있다.

Abstract

Looking at the trend of the elderly with dementia, the number of people aged 65 or older with dementia is expected to exceed approximately 840,000 in 2020, 1.36 million in 2030, 2.17 million in 2040, and 3 million in 2050. In the case of elderly people with dementia, it can be said that the crime incidence rate is highest among dementia patients suffering from frontotemporal dementia. The most frequent crime among elderly people with dementia is property crime, followed by traffic crime, violent crime (violence), and violent crime (violent crime). This crime trend can also be confirmed in overseas studies targeting criminals with dementia. Dementia is a disease that involves cognitive impairment and brain damage. In Korea, there are still no judgment standards set forth in Supreme Court precedent regarding the criminal responsibility of dementia criminals, and there are no judgment standards regarding whether to recognize a mental disorder or accurately diagnose a dementia criminal. Punishment for crimes committed by dementia patients for whom further treatment is impossible and for whom treatment, custody, etc. is meaningless, needs to be approached from a different direction. Regarding the accuracy of dementia diagnosis and the diversity of diagnostic methods depending on the characteristics of each type, it is not possible to estimate the type and prevalence of mental disorders in young offenders to design forensic psychiatric evaluation and psychiatric services for older people. When it comes to treating criminals after diagnosis, it can be said that treatment services accompanied by strategic preventive treatment or professional treatment related to the establishment of a social safety net are necessary.
