장애인의 자기결정권 강화 논쟁: 개인예산제를 중심으로

초록

본 연구는 장애인의 자기결정권 강화를 위한 대안 중 하나로 장애인 개인예산제를 둘러싼 논쟁과 그 대립지형을 점검하고자 한다. 장애인 개인예산제란 사회서비스를 현금으로 지급하여 장애인이 자율권을 행사하도록 만든 전달체계를 일컫는다. 전달 체계 개편 과정에서 그간 학계에서 진행되어 오던 제도의 구조 분석과 접근방식을 벗어나, 자기결정권을 중심으로 장애인 당사자들 스스로가 개인예산제를 어떻게 받아들이고 해석하는지를 살펴보고자 하였다. 주요 선행사례인 영국과는 달리, 한국은 장애인 당사자들 내에서도 개인예산제에 대한 입장이 큰 차이를 보인다. 이는 사회복지학적 관점의 제도분석을 벗어나 제도를 둘러싼 행위자들과 그 주장을 고찰하는장애학적 분석의 필요성을 보여준다. 기존문헌과 함께 서울시의 시범사업 추진 및 윤석열 정부의 대선기간 중 공약화에 따른 각 장애인 단체의 성명서, 보도자료, 언론 기사 등에 대한 문헌분석을 시도하였다. 그 결과, 학계에서 정책사례로 소개된 개인예산제는 현 정부의 국정과제로 채택되기에 이르렀으며, 장애인 단체 내부에서도 찬반을 둘러싼 팽팽한 대립이 관찰된다. 개인예산제를 반대하는 입장은 개인예산제가 가져올 수 있는 장애인의 자기결정권 강화 효과 보다는 이로 인한 장애정책의 사회공공성 약화에 더 큰 비중을 두고 있다. 이는 장애정책 영역의 예산 확보에 대한 신뢰가 부족한 상황에서 장애정책의 사회권 강화 없이 자유권만 주어졌을 때 자유로운 선택이 가능할 수 있는가에 대한 우려를 나타낸 것이다. 이와 함께, 개인예산제 도입 논쟁은 정책 의도와 그 결과간의 괴리를 좁힐 수 있을 때 합의에 이를 수 있는 것으로 나타난다. 개인예산제 찬성 입장은 정책의 의도에 주목하는 한편, 반대 입장은 정책의 결과를 불신하는 것으로 보인다. 따라서 각 입장은 개인예산제의 의도와 결과라는 서로 다른 영역만을 바라보고 있으며, 이에 대한 인식이 논의에 전제되어야 할 것이다.

Abstract

This study analyses the controversy and conflicting landscape surrounding the personal budget as one alternative to improving self-determination rights for people with disabilities. The personal budget for the disabled refers to a delivery system that allows the disabled to exercise autonomy by providing social services in cash. In the process of reforming the delivery system, we examine how disabled people accept and interpret the personal budget, with a focus on self-determination rights. We step away from using a structural analysis approach, a more commonly used method and framework for examining the personal budget in academia. Unlike the United Kingdom, which set a major precedent, Korea shows a significant difference in its position on the personal budget, even among people with disabilities. This presents the need for a disability studies analysis to examine the actors and claims surrounding the system that goes beyond an institutional analysis from a social welfare perspective. We analyze documents, including statements, press releases, and media articles of each disabled group, in addition to existing literature that discusses the promotion of the Seoul pilot project and the pledges made by the Yoon Seok-yeol administration during the presidential election. Results indicate that the personal budget, first introduced in academia as a policy case, has come to be adopted as a national task of the current government. We also show that a tense confrontation over pros and cons exists within groups of the disabled. Those that oppose the personal budget place greater emphasis on the weakening of disability policies’ social publicity rather than on the effects the personal budget would have on strengthening the self-determination rights of the disabled. This is based on concerns over whether free choice is possible when only the right to freedom is presented without strengthening social rights through a disability policy in a context where there is insufficient trust in securing a budget for disability policies. At the same time, the debate about introducing the personal budget appears to reach an agreement when the gap between policy intentions and results can be narrowed. Those favoring the personal budget pay attention to policy intent, while those opposing distrust the policy outcome. Therefore, as each position focuses on different factors, intentions and results of the personal budget, recognizing such discrepancies should be a prerequisite for the discussion.
