Abstract
The recent development in internet and SNS leads to being expanded the possibility that an individual's private territory will be infringed. Especially, according to the growth in personal information collection activities and to the development in IT devices, the importance of protecting privacy is getting important. The right of privacy in America is being interpreted as the freedom on an individual's privacy territory without other person's interference. The right of privacy in our country is being understood as a right available for demanding the tranquility and secret of privacy without being lavishly disclosed privacy. In addition, it is the legal capacity available for positively managing and controlling own information. Our society has the world's top level in technology and speed of information and communication such as internet. But in proportion to the technical progress speed, the policy-based and legislative response to personal information can be considered to lag behind. This is because there is also a characteristic as saying that the development speed in information communication technology is fast enough for making a policy-based or legal review and for applying it realistically. This leads to being not effectively achieved the legislative purpose owing to the appearance in new technology even though being existed several laws for protecting personal information such as the Law on Promotion of Information and Communications Network Utilization and Information Protection etc. This study aims to examine the development process in a discussion about the protection of a privacy right focusing on the judgments pertinent to an individual's private fact in case of America that emphasizes the freedom of expression.
