Abstract
As the rising influence of multinational corporations is widely accepted to current international law and public society, it is a natural recognition that businesses need to accept greater responsibility for their actions because their profit making actions may infringe on others’ rights and may be socially and environmentally irresponsible. In 2000, the UN adopted a Global Compact as an essential guide for undertaking socially and environmentally responsible business. The Compact leads corporate participants to be required to “embrace, support and enact” ten principles in the areas of human rights, labor, the environment and anti-corruptions. However, the Compact operates on a purely voluntary basis, that is soft law mechanism having voluntary standards and framework agreements. They have been criticized for the vagueness and subjectivity of the commitments they elicit from their participants. Although the term of corporate social responsibility is generally assumed to have been born in West, CSR is not an exclusively Western notion. Although not mentioned in the Quran or Sunnah, the substance of CSR is really the essence of the Islamic faith and law. Islam to Muslim is not just a faith; it is also the law that governs their lives and the way they choose to live their lives. Thus, the teachings of Sharia not only appear to be the similarity of the Ten Principles of the U.N. Global Compact, but in respects go further than the minimum standards adopted by its framework. CSR and Sharia also agree that while a corporation has the freedom to pursue profits, such freedom ends at the point where the freedom of others and the well-being of the environment conflict with this pursuit. If the commercial rules in Sharia were more regarded in the West, some of the complications of the current CSR problems would not have taken place.
