저탄소 녹색도시 제도의 운영실효성에 관한 연구- 저탄소 녹색도시 조성을 위한 도시･군계획수립지침에 의거한 경기도를 중심으로 -

본 연구에서는 저탄소 녹색성장과 이에 따른 저탄소 녹색도시를 구현하기 위해 제도적으로 제정되어 운영되고 있는 ‘저탄소 녹색도시 조성을 위한 도시･군계획수립지침’에 있어 그 실효성 여부가 매우 불투명한 상태에 있다. 이에 대한 제도개선을 위한 제고 방안을 찾아보자는 데 연구의 주안점을 두었다. 그 결과 다음과 같은 실효성 제고와 지속성 방안을 도출할 수 있었다. 먼저, 전문가로 분류한 시･군에서 도시계획업무를 맡고 있는 담당자들의 공통적인 의견은 기존 운영되고 있는 제도에 환경보전과 관리계획에 통합하는 것, 그리고 의무화나 강제성 및 법적 구속력이 없으므로 제도의 실효성에 대한 한계 도출, 궁극적으로는 기존 행정규칙인 관련 수립지침과의 통합성에 기인해야 한다는 점에 의견을 제시하였으며, 이를 위해서는 법제화에 있어서 국토기본법과 국토계획법, 그리고 저탄소 녹색성장 기본법과의 상호관계성을 확보하여야 한다는 것이다. 그래서 현 저탄소 녹색도시 지침과 도시계획관련 지침(광역도시계획, 도시･군기본계획, 도시･군관리계획)간 통합성을 제기했으며, 3단계 구조로 통합･체계화하는 것이 필요하다는 것을 제시하였다. 하지만 무엇보다도 중요한 것은 실질적인 실행력으로 실천해야 하는 해당 지방자치단체의 실행의지와 개선노력의 필요성을 제시하였다.
Abstract
The “Guideline of Urban and Country Planning for Low-Carbon Green City” has been established to realize low-carbon green growth and thus low-carbon green cities. However, effectiveness of that guideline is highly uncertain. Therefore, we focused on finding ways to improve the effectiveness of low carbon green city system and the following measures of effectiveness and sustainability were derived. As this policy is neither mandatory nor legally binding its effectiveness is restricted, therefore the city and country urban planners classified as experts believe that it is necessary to integrate the existing management plan with the environment preservation policy, as well as the existing administrative rules with the relevant establishment guideline. In order to do this, it is necessary to secure the interrelationship among Framework Act on the National Land, National Land Planning and Framework Act on Low Carbon Green Growth. Therefore, we suggest integrating current Low-Carbon Green City guideline with urban planning guidelines (Metropolitan Development Plan, Urban and Country Master Plan, and Urban and Country Management Plan) and implementing the integrated and systematized three-stage structure. However, more importantly, the willingness to carry out practical implementation and improvement efforts of corresponding local autonomous entities is required.
