자녀양육 협의를 위한 이혼중재 서비스 고찰

초록

이혼 과정 중 양육문제의 협의는 단지 누가 키울 것인지의 문제 뿐 아니라 이혼 후 부모가 어떻게 부모역할을 공동으로 분담할 것인지에 관한 구체적 양육계획이 포함되며 결과적으로 자녀에게 피해가 최소화되기 위한 과정이다. 날로 급증하는 이혼율의 증가와 국내 이혼의 80% 이상이 협의이혼을 하고 있는 시점에서 이혼과정에서 자녀양육관련 문제를 효과적으로 결정하고 협의하기 위한 제반 서비스는 매우 미비한 상태에 있다. 최근 이러한 문제를 해결하기 위해 이혼제도의 개혁 및 변화를 활발히 도모하고 있는 중이다. 본 연구는 자녀의 최대복리 관점을 중심으로 하는 서구의 이혼과정에서의 자녀양육의 기본관점과 동향을 살펴보고, 최근 20 여 년 간 가장 활발하게 성장하여온 미국의 이혼중재 서비스에 대한 광범위한 문헌고찰을 실시하였다. 현재 미국의 경우 39개 주에서 이혼중재 서비스에 대한 법제화가 진행되어 있으며 이혼중재서비스의 효과성이 입증되고 있다. 본 연구는 미국의 이혼중재 서비스를 개괄하고, 중재의 특징 및 효과성을 검토하였고, 대상에 따른 다양한 중재모델에 대해 개괄하였다. 이혼중재서비스의 한국적 적용가능성을 위해 연구에서 밝히고 있는 함의로는 자녀양육 협의를 위한 이혼중재서비스의 필요성이 인식되어야 하며, 현재 추진되고 있는 이혼제도의 개혁에서 자녀양육 협의를 위한 중재서비스의 확충을 제안하였다. 또한, 우리나라 이혼자들의 갈등 영역 및 성격 규명을 위한 선행연구의 필요성과 이혼 후 양육분담에 관한 한국적 가치정립 및 사회적 합의가 이루어질 때에 적절한 협의중재가 이루어질 수 있음을 강조하였다. 자녀양육 협의과정에서의 전문적 개입은 이혼부모가 부모역할과 책임을 다할 수 있도록 하며 이혼 후 자녀복리를 확보하기 위한 최선의 방법이며, 이를 수행할 중재전문 인력의 양성 및 훈련 또한 필요하겠다, 본 연구는 국내에서는 다소 생소한 이혼중재의 영역을 소개함으로 한국적 상황에 적합한 중재서비스의 도입가능성에 대한 논의를 시도함에 의의를 두었다.

Abstract

Divorce rate has increased drastically in Korea for recent years. Various efforts to decrease divorce and to support divorcing families are discussed at the level of national wide policy, as well as practice in the field. For the best interest of children and minimizing negative effects toward children at divorce process, co-parenting plan should be mutually agreed between parents including child custody, child support and visitation, However, services for parental negotiation to plan child rearing issues have not been sufficient to accommodate extensive needs of divorce parents in Korea. The purpose of this study is to examine the basic ideas and trends of parenting after divorce in the U.S. and to review its divorce mediation service, which is accepted as effective in dealing with child custody issue of divorcing family in respect of legal and social supporting systems. This study also covers general overview, effectiveness of mediation, and divorce mediation models. The implication provides the validity and applicability of divorce mediation in Korea as a conclusion. It highlights the necessity of mediation for parental negotiation of child rearing issues and training courses for professional mediation, which help families to achieve the ultimate goal of the best interest of children by empowering parents to be still parents after divorce.
