본고는 이혼 전 상담 제도의 시행을 앞두고, 이혼 상담 관련 국내외 문헌과 이혼 상담 사례 논문들을 바탕으로 이혼 전 상담에서 상담자가 주의해야할 임상적 쟁점들을 고찰하였다. 이혼 전 상담은 부부가 이혼 여부에 대한 합리적인 의사결정을 돕고 이혼을 최선책으로 선택하였을 경우 가능한 건설적인 가족해체를 돕는 과정으로, 크게 이혼 숙려 단계(의사결정단계)와 이혼 재구성 단계(이혼결정 후 법률적 이혼 전까지)로 나눌 수 있다. 이혼 숙려 단계에서 중요한 임상적 쟁점으로 상담을 요청한 시기, 이혼 상담에서의 사정, 개인 대 부부상담의 쟁점, 상담자 본인의 문제, 내담자의 양가적 태도와 이혼결정 등을 살펴보았다. 이혼 재구성 단계에서의 쟁점으로는 건설적 이혼의 기준, 내담자의 분노감과 상실감 다루기, 이혼과 자녀문제, 이혼중재 등을 고찰하였다. 이혼 전 상담은 기본적으로 부부 모두 참석하는 것이 원칙이며, 수용, 경청 등 상담의 기본원리 외에도 결혼관계와 이혼역동에 대한 상담자의 지식을 요한다. 이혼 전 상담이 지속적으로 증가하는 이혼율을 막고 이혼자와 그 가족들에게 보다 긍정적으로 이혼을 경험하도록 조력함으로서 이혼으로 인한 사회적 비용을 절감해줄 것으로 기대하고 있다. 그러나 이혼 전 상담을 받을 수 있는 전문기관의 부족과 상담 인력의 전문성 보장의 문제는 여전히 과제로 남아있다.
Abstract
This paper examines the clinical issues in the process of pre-divorce counseling based on the domestic and foreign literature of the divorce counseling and on the case studies of divorce counseling. Pre-divorce counseling may be categorized by two phases, divorce decision-making stage and divorce restructuring stage. The former is characterized by the stage when the counselor helps the couple clients to decide whether to divorce or not based on the reasonable decision-making process. The important clinical issues to keep in mind in this stage are the timing of the counseling, assessment of the couple relationship, individual counseling vs. couple counseling, counselor's issues, and dealing with client's ambivalence. Meanwhile during the divorce restructuring stage, once the couple decide to divorce, counselor needs to help the clients to experience the divorce as positive as possible so that they can make their lives better. The important clinical issues during this stage are criteria of positive divorce, dealing with client's anger and loss, separation and divorce mediation.
