최근 미국 D.C. 항소 법원은 Verizon v. FCC 판결에서 연방통신위원회(FCC: Federal CommunicationsCommission)가 제정한 오픈 인터넷 규칙(Open Internet Order)이 미국 통신법을 위반하였다고 판결하였다. 이 판결에따라 미국 인터넷 접속 서비스 사업자는 그 동안 금지되어 왔던 관리형 서비스를 제공할 수 있게 되었을 뿐만 아니라 차별적인 망 사용대가를 합법적으로 과금할 수 있게 되었다. 이에 따라 지난 2014년 5월에 FCC는 새로운 망중립성 정책을 제시하였다. 본 논문은 이 사례를 심도있게 분석하고 더 나아가 FCC가 제안한 망중립성 정책이 Verizon 판결과 부합하지 않을가능성에 대해 분석한다. 마지막으로 새로운 망중립성 정책이 산업에 미치는 영향도 함께 분석한다.
Abstract
Recentely, in Verizon v. FCC, D.C. Circuit Court held that the Open Internet Order, promulgated by theFederal Communications Commission, violates the Telecommunications Act of 1996. Accordingly, InternetService Providers can not only provide managed services, but also can legally charge different fees to ContentProviders for accessing their networks. As a result, in most countries, managed service is now legally permitted,and it is foreseeable that in the near future diverse managed services will be sold in the market. However, themanaged services can also cause other legal disputes.
