한국 경찰의 감찰제도 개선방안에 관한 연구

경찰공무원의 감찰 및 징계제도는 타 부처의 공무원보다 제반절차가 불합리하며 엄격하고 가혹하다는 인식이 경찰관들 사이에 일반적이다. 이는 감찰 및 징계제도에 대한 불신을 초래하여 사기를 저하시키는 원인이 된다. 따라서 본 연구는 감찰 및 징계제도의 바람직한 개선방안에 대한 제안을 하는데 그 목적이 있다. 이를 위해 선행연구 검토를 통하여 경찰징계의 개념, 사유, 종류와 효력, 절차 등의 연구의 이론적 배경을 고찰하고, 우리나라 경찰공무원의 징계종류별 현황을 살펴본 후 현행 징계제도의 절차와 판단기준에 대한 문제점을 도출하였다. 끝으로 이러한 감찰 및 징계제도의 문제점들을 개선하기 위한 방안들로 외부인사의 참여와 징계위원회의 상설기구화, 징계혐의자에 대한 변호인 선임권의 보장 등을 제시하였다.
Abstract
Because of inherent problems of the police disciplinary system in Korea, police officers has deep distrust in disciplinary system and demoralization among them. So it is necessary to present reform measures to remedy these problems. The purpose of this study is to suggest the efficient plan for improving the disciplinary system of Korean National Police. To fulfill this research purpose, the author conducted literature review on the definitions and legal properties of police disciplinary system, causes of disciplinary action, actual conditions of police disciplinary system, and the trait of police discipline. In this research the problems of procedure and judgment in the police disciplinary system also have been examined. Outsider's participation in the disciplinary committee, guarantee of rights for counsels, establishment of clear-cut lines of police officers responsibilities, and etc. were suggested as a part of remedy.
