통신서비스 기술표준에 관한 최근 한미간 협상은 서비스분야 표준화의 국가적 중요성을 실감하게 하는 통상협상 사례이다. 동 협상은 통신서비스 기술표준에 관한 관할협정 및 WTO협정 합치성 문제에 대한 극명한 견해 차이를 수반했다는 점에서 통상법적 관점에서도 관심 대상이 되고 있다. 협상전략 차원에서는 DDA 및 FTA협상 등 국제협상에서 통신서비스 기술표준에 관해 예상되는 쟁점들에 대한 바람직한 대응방향을 모색할 수 있는 경험적 기반을 제공한다. 이러한 맥락에서 본고는 한미간 WIPI협상 사례와 통신서비스 기술표준관련 국제협상동향 분석을 통해 통상법적ㆍ협상전략적 시사점을 찾고자 한다.
Abstract
The recent Korea-US disputes over technical standards on telecom services is a typical case of trade negotiations that realizes us the importance of standardization in services area from the national perspectives. They make a matter of concern from the viewpoint of trade law in that they entail plenty of dissenting opinions between the two countries about the jurisdiction over technical standards on telecom services and their compatibility with WTO agreements as well. Additionally, it may be asserted that practical experiences accumulated during the negotiations will do much towards preparing desirable guidelines to cope with the possible issues on the technical standards in international trade negotiations such as DDA and FTA's. With these motivations, this paper seeks to learn lessons for trade law and negotiation strategies through analyzing the Korea-US disputes over WIPI and movements in other international trade negotiations over technical standards in telecom services area.
