환율문제에 대한 통상법적 제재 연구

환율조정을 통한 수출경쟁력을 확보하여 자국의 수출을 늘리고 실업을 해소하기 위해, 경쟁적으로 자국의 통화가치를 떨어뜨리는 이른바 환율전쟁이 계속되고 있다. 지난 10여 년간 미국의회는 교역국의 저평가된 통화에 대해서 제재할 방안을 마련하는데 노력을 기울여 왔다. 또한 지속되고 있는 글로벌 불균형과 강달러 추세를 다루기 위해 2015년 2월 10일, 미국의회는 교역국의 저평가된 통화가치에 대해 저평가된 부분을 보조금으로 보고 상계관세를 부과하는 법안을 발의하였고, 본 법안 중 상원 법안은 2015년 5월 14일 상원을 통과하였고 9월 현재 계류 중에 있다. 그러나 보조금과 상계조치에 관한 협정에 따르면 상계관세가 부과되기 위해서는 보조금이 존재하여야 하는데, 최근 발의된 관련 법안은 보조금의 요건인 혜택과 특정성의 부인으로 SCM협정상 규율되는 보조금이 존재한다고 보기 어려운 바, 상계조치가 취해진다면 WTO법상 위반으로 판단될 것으로 생각된다. 관련해서 얼마전 타결된 TPP에 환율관련 규정이 포함된 것으로 알려졌는데 아직은 정확한 협정문이 나오기 전으로, 향후 한국은 이에 좀 더 관심을 가지고 내용파악 및 영향분석에 노력을 기울일 필요가 있을 것으로 생각된다. 국제금융과 국제통상의 밀접성을 고려할 때, 국제금융 특히 환율문제를 통상법적 차원에서 바라보게 될 가능성은 충분하다. 그러나 환율문제가 어떠한 지역에만 국한된 문제가 아니라 세계전체적인 문제임을 감안할 때, 바람직한 해결책은 적정환율에 대한 세계 전체적 합의가 도출되어 적용되고 이에 따른 제재안도 마련되는 것이라 생각한다. 전체적 합의를 통해 적정환율에 대한 규범과 제재방안이 속히 마련될 수 있기를 기대해 본다.
Abstract
Since weakening the value of one country’s currency can lead to boost exports and create jobs, countries compete against each other to achieve a relatively low exchange rate for their own currency at the expense of other countries. Against this backdrop, over the past decade, the US Congress has been tried to establish rules to address undervalued currency. In context of handling the sustained global imbalance and strong dollar, both Houses of the US Congress submitted bills on February 10, 2015 to authorize countervailing duties against exports subsidized by undervalued currencies. This paper analyses whether a countervailing duty(CVD) applied according to US currency legislation would be consistent with WTO’s Subsidies and Countervailing Measures(SCM) Agreement. This Paper concludes due to several significant potential obstacles related to ‘benefits conferred’ and ‘specificity’, it would be hard to justify the measure of imposing countervailing duty to allegedly undervalued currencies under SCM Agreement. Meanwhile, according to sources, the currency provisions are included in the recently completed TPP. Since Seoul is open to the possibility of joining the TPP, it would be wise to explore the text after the release of it and examine the impact. Considering the low exchange rate problem is a global one not confined to the specific region, in order to better address it, countries all over the world should make efforts to set the world currency policy rules through international agreements. Hope that the global rules for the currency policy be established soon.
